  1                      A bill to be entitled

  2         An act relating to the interdistrict transfer

  3         and use of water; amending s. 373.2295, F.S.;

  4         redefining the term "interdistrict transfer and

  5         use"; validating and providing continued effect

  6         of agreements between water management

  7         districts which were entered into before the

  8         effective date of the act; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (1) of section 373.2295, Florida

14  Statutes, is amended to read:

15         373.2295  Interdistrict transfers of groundwater.--

16         (1)  As used in this section, the term "interdistrict

17  transfer and use" means a consumptive water use that which

18  involves the withdrawal of groundwater from a point within one

19  water management district for use outside the boundaries of

20  that district, but does not include a withdrawal and use

21  within the same county. In case of withdrawal of groundwater

22  from a point within one water management district for use

23  outside the boundaries of that district but within the same

24  county, the provisions of subsections (4), (11), and (13)

25  shall apply, and the district considering a permit application

26  for such a consumptive use shall apply the applicable

27  provisions of this chapter, and its rules, to the withdrawal

28  and use.

29         Section 2.  Any agreements between water management

30  districts entered into before the effective date of this act

31  pursuant to section 373.046, Florida Statutes, authorizing the

 1  issuance of permits for the interdistrict withdrawal and use

 2  of water within a county are validated and shall continue in

 3  effect until otherwise rescinded.

 4         Section 3.  This act shall take effect upon becoming a

 5  law.
