| 5 | state; providing exceptions; providing an effective date. | ||

| 7 | Be It Enacted by the Legislature of the State of Florida: | ||
| 8 | |||
| 9 | Section 1. Section 283.551, Florida Statutes, is created | ||
| 10 | to read: | ||
| 11 | 283.551 Unsolicited distribution of general reports by | ||
| 12 | mail prohibited; exceptions.-- | ||
| 13 | (1) Unless otherwise authorized by law, no agency shall | ||
| 14 | mail an unsolicited copy of a general report or newsletter by | ||
| 15 | United States Postal Service, or other method of delivery, | ||
| 16 | except e-mail, to any person, including an elected or appointed | ||
| 17 | officer or governmental employee, or to any state or local | ||
| 18 | governmental entity. Nothing in this section applies to | ||
| 19 | regulatory newsletters provided to affected persons or to | ||
| 20 | reports or newsletters relating to the prevention or treatment | ||
| 21 | of disease or injury. | ||
| 22 | (2) An agency shall send to any person, including an | ||
| 23 | elected or appointed officer or governmental employee, or to any | ||
| 24 | state or local governmental entity, a copy of a general report | ||
| 25 | or newsletter by United States Postal Service, by e-mail, or by | ||
| 26 | other method of delivery: | ||
| 27 | (a) Upon a specific request for a particular report or | ||
| 28 | newsletter; or | ||
| 29 | (b) Upon a general request to receive all agency reports | ||
| 30 | or newsletters, which request must be renewed as provided in s. | ||
| 31 | 283.55. | ||
| 32 | (3) A request for a report or newsletter must state | ||
| 33 | whether the recipient wishes to receive the document by regular | ||
| 34 | mail, by e-mail, or by other method of delivery. | ||
| 35 | (4) An agency may post any general report on its Internet | ||
| 36 | website. | ||
| 37 | Section 2. This act shall take effect upon becoming a law. | ||
