2 An act relating to the Florida Statutes;
3 amending ss. 411.226, 1011.31, 1011.42, and
4 1013.12, F.S., to conform to the directive in
5 s. 1, ch. 93-199, Laws of Florida, to remove
6 gender-specific references applicable to human
7 beings from the Florida Statutes without
8 substantive change in legal effect.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (f) of subsection (2) of section
13 411.226, Florida Statutes, is amended to read:
14 411.226 Learning Gateway.--
15 (2) LEARNING GATEWAY STEERING COMMITTEE.--
16 (f) Steering committee appointments must be made, and
17 the committee must hold its first meeting, within 90 days
18 after this act takes effect. Steering committee members shall
19 be appointed to serve a term of 3 years. The Governor shall
20 designate the chair chairman of the steering committee.
21 Section 2. Subsection (2) of section 1011.31, Florida
22 Statutes, is amended to read:
23 1011.31 Current loans to community college boards of
24 trustees.--
25 (2) The Commissioner of Education shall approve such
26 proposal when, in his or her opinion, the proposal is
27 reasonable and just, the expenditure is necessary, and
28 revenues sufficient to meet the requirements of the loan can
29 reasonably be anticipated.
30 Section 3. Subsection (6) of section 1011.42, Florida
31 Statutes, is amended to read:

1 1011.42 University depositories; deposits into and
2 withdrawals from depositories.--
3 (6) The university president or his or her designee,
4 after having been specifically authorized by the university
5 board of trustees, may transfer funds from one depository to
6 another, within a depository, to another institution, or from
7 another institution to a depository for investment purposes
8 and may transfer funds in a similar manner when the transfer
9 does not represent an expenditure, advance, or reduction of
10 cash assets.
11 Section 4. Subsection (7) of section 1013.12, Florida
12 Statutes, is amended to read:
13 1013.12 Casualty, safety, sanitation, and firesafety
14 standards and inspection of property.--The State Board of
15 Education shall adopt and administer rules prescribing
16 standards for the safety and health of occupants of
17 educational and ancillary plants as a part of State
18 Requirements for Educational Facilities or the Florida
19 Building Code for educational facilities construction as
20 provided in s. 1013.37, except that the State Fire Marshal in
21 consultation with the Department of Education shall adopt
22 uniform firesafety standards for educational and ancillary
23 plants and educational facilities, as provided in s.
24 633.022(1)(b), and a firesafety evaluation system to be used
25 as an alternate firesafety inspection standard for existing
26 educational and ancillary plants and educational facilities.
27 The uniform firesafety standards and the alternate firesafety
28 evaluation system shall be administered and enforced by local
29 fire officials. These standards must be used by all public
30 agencies when inspecting public educational and ancillary
31 plants, and the firesafety standards must be used by local

1 fire officials when performing firesafety inspections of
2 public educational and ancillary plants and educational
3 facilities. In accordance with such standards, each board
4 shall prescribe policies and procedures establishing a
5 comprehensive program of safety and sanitation for the
6 protection of occupants of public educational and ancillary
7 plants. Such policies must contain procedures for periodic
8 inspections as prescribed herein and for withdrawal of any
9 educational and ancillary plant, or portion thereof, from use
10 until unsafe or unsanitary conditions are corrected or
11 removed.
12 (7) ANNUAL REPORT.--The State Fire Marshal shall
13 publish an annual report to be filed with the substantive
14 committees of the state House of Representatives and Senate
15 having jurisdiction over education, the Commissioner of
16 Education or his or her successor, and the Governor
17 documenting the status of each board's firesafety program,
18 including the improvement or lack thereof.
