  1                      A bill to be entitled

  2         An act relating to bus transportation; amending

  3         s. 316.70, F.S.; requiring the driving records

  4         of nonpublic sector bus drivers to be checked

  5         for suspended or revoked licenses; providing

  6         that private school students may ride on public

  7         school buses and public school students may

  8         ride on private school buses, subject to

  9         specified conditions; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Paragraph (d) is added to subsection (1) of

15  section 316.70, Florida Statutes, to read:

16         316.70  Nonpublic sector buses; safety rules.--

17         (1)  The Department of Transportation shall establish

18  and revise standards to assure the safe operation of nonpublic

19  sector buses, as defined in s. 316.003(78), which standards

20  shall be those contained in 49 C.F.R. parts 382, 385, and

21  390-397 and which shall be directed towards assuring that:

22         (d)  The driving records of drivers of nonpublic sector

23  buses are checked by their employers at least once each year

24  to ascertain whether the driver has a suspended or revoked

25  driver's license.

26         Section 2.  Private school students may be transported

27  on public school buses and public school students may be

28  transported on private school buses when there is mutual

29  agreement between the local school board and the applicable

30  private school. Any agreement for private school students to

31  be transported on public school buses must be in accordance

 1  with sections 768.28(9)(a) and 316.6145, Florida Statutes. Any

 2  agreement for public school students to be transported on

 3  private school buses must be contingent on the private school

 4  bus driver's having adequate liability insurance through his

 5  or her employer.

 6         Section 3.  This act shall take effect July 1, 2003.

 9                          SENATE SUMMARY

10    Provides for the standards of the Department of
      Transportation to require that the driving records of
11    nonpublic sector bus drivers be checked by the employer
      at least once each year for suspended or revoked
12    licenses. Provides requirements under which private
      school students may ride on public school buses and
13    public school students may ride on private school buses.
