3 253.71, F.S.; eliminating obsolete provisions
4 relating to lease fees and surcharges for the
5 use of submerged lands; providing an effective
6 date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraph (a) of subsection (2) of section
11 253.71, Florida Statutes, is amended to read:
12 253.71 The lease contract.--When the board has
13 determined that the proposed lease is not incompatible with
14 the public interest and that the applicant has demonstrated
15 his or her capacity to perform the operations upon which the
16 application is based, it may proceed to consummate a lease
17 contract having the following features in addition to others
18 deemed desirable by the board:
19 (2) RENTAL FEES.--
20 (a) The lease contract shall specify such amount of
21 rental per acre of leased bottom as may be agreed to by the
22 parties and shall take the form of fixed rental to be paid
23 throughout the term of the lease. Beginning January 1, 1990,
24 A surcharge of $10 $5 per acre, or any fraction of an acre,
25 per annum shall be levied upon each lease according to the
26 guidelines set forth in s. 597.010(7). Beginning January 1,
27 2001, the surcharge shall be increased to $10 per acre, or any
28 fraction of an acre, per annum.
29 Section 2. This act shall take effect upon becoming a
30 law.
