2 An act relating to community care for the
3 elderly; amending s. 430.205, F.S.; providing
4 guidelines for prioritizing services; providing
5 an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (5) of section 430.205, Florida
10 Statutes, is amended to read:
11 430.205 Community care service system.--
12 (5) Any person who has been classified as a
13 functionally impaired elderly person is eligible to receive
14 community-care-for-the-elderly core services. Those elderly
15 persons who are determined by protective investigations to be
16 vulnerable adults in need of services, pursuant to s.
17 415.104(3)(b), or to be victims of abuse, neglect, or
18 exploitation who are in need of immediate services to prevent
19 further harm and are referred by the adult protective services
20 program, shall be given primary consideration for receiving
21 community-care-for-the-elderly services. As used in this
22 subsection, "primary consideration" means that an assessment
23 and services must commence within 72 hours after referral to
24 the department or as established in accordance with department
25 contracts by local protocols developed between department
26 service providers and the adult protective services program.
27 Another factor that must be considered in prioritizing these
28 services is the potential recipient's ability to pay. Those
29 who are less able must receive higher priority than those who
30 are better able to pay.
31 Section 2. This act shall take effect July 1, 2003.

3 Provides that a factor in prioritizing services under the
"Community Care for the Elderly Act" must be the
4 potential recipient's ability to pay, and higher priority
must go to those who are less able to pay.
