  1                      A bill to be entitled

  2         An act relating to Purple Heart license plates;

  3         amending s. 320.089, F.S.; providing for the

  4         issuance of such plates without charge to

  5         Purple Heart medal recipients or their

  6         unmarried surviving spouses, regardless of the

  7         recipient's degree of disability; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Paragraph (c) of subsection (1) and

13  subsection (3) of section 320.089, Florida Statutes, are

14  amended to read:

15         320.089  Members of National Guard and active United

16  States Armed Forces reservists; former prisoners of war;

17  survivors of Pearl Harbor; Purple Heart medal recipients;

18  special license plates; fee.--

19         (1)

20         (c)  Notwithstanding any provisions of law to the

21  contrary, an applicant for a Purple Heart license plate,

22  regardless of the applicant's degree of disability, or an

23  applicant for a Pearl Harbor Survivor license plate or a

24  Purple Heart license plate who also qualifies for a disabled

25  veteran's license plate under s. 320.084 shall be issued the

26  appropriate special license plate without payment of the

27  license tax imposed by s. 320.08.  

28         (3)  Each owner or lessee of an automobile or truck for

29  private use, truck weighing not more than 7,999 pounds, or

30  recreational vehicle as specified in s. 320.08(9)(c) or (d),

31  which is not used for hire or commercial use, who is a

 1  resident of this state and who is the unremarried surviving

 2  spouse of a recipient of the Purple Heart medal shall, upon

 3  application therefor to the department, with the payment of

 4  the required fees, be issued a license plate as provided in s.

 5  320.06, on which license plate are stamped the words "Purple

 6  Heart" and the likeness of the Purple Heart medal followed by

 7  the serial number. Each application shall be accompanied by

 8  proof that the applicant is the unremarried surviving spouse

 9  of a recipient of the Purple Heart medal.

10         Section 2.  This act shall take effect July 1, 2003.
