An act relating to environmental protection; providing a |

popular name; providing for remediation of contaminated |
4
|
sites in counties and municipalities; authorizing the |
5
|
Department of Environmental Protection to adopt rules and |
6
|
issue orders; providing for enforcement; providing for |
7
|
control in the event of conflict of provisions; providing |
8
|
an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. This act shall be known by the popular name the |
13
|
"Public Resource Protection Act."
|
14
|
Section 2. Counties and municipalities that own sites with |
15
|
soil or water contamination shall remediate such sites to the |
16
|
same extent as is required for brownfield sites under s. 376.81, |
17
|
Florida Statutes.
|

|
Section 3. The Department of Environmental Protection may |
19
|
adopt such rules and issue such orders as may be necessary to |
20
|
carry out the provisions of this act.
|

Section 4. The provisions of this act may be enforced |
22
|
pursuant to ss. 120.69, 120.695, 376.83, 403.141, 403.161, and |
23
|
403.412, Florida Statutes.
|

Section 5. If any provision of this act or of the rules |
25
|
adopted pursuant to this act is in conflict with any other |
26
|
provision, limitation, or restriction which is now in effect |
27
|
under any law of this state or any ordinance of a local |
28
|
government, political subdivision, or municipality, or any rule |
29
|
or regulation adopted thereunder, the provisions of this act or |
30
|
of the rules adopted pursuant to this act shall control; |
31
|
provided, however, that a local government, political |
32
|
subdivision, or municipality is not prohibited from adopting and |
33
|
enforcing more stringent provisions. |

|
Section 6. This act shall take effect upon becoming a law. |
