  1                      A bill to be entitled

  2         An act relating to recreational activities at

  3         facilities for elderly or disabled adults;

  4         authorizing bingo games for residents or

  5         clients of certain facilities for the elderly

  6         or disabled and for their guests; providing

  7         conditions; providing for use of proceeds;

  8         providing exemption from local regulation and

  9         fees; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Notwithstanding the provisions of section

14  849.0931, Florida Statutes, bingo games for residents or

15  clients of a facility licensed or authorized under part II,

16  part III, or part V of chapter 400, Florida Statutes, chapter

17  651, Florida Statutes, or section 430.206, Florida Statutes,

18  and for their guests, or for residents of government-financed,

19  government-insured, or government-subsidized housing for the

20  elderly and their guests, may be conducted if such games are

21  held in the facility, played exclusively by residents or

22  clients and their guests, and conducted by residents, staff,

23  or volunteers of the facility, and if neither the facility nor

24  any third party derives financial benefit from such games.

25  Games conducted for residents or clients with a diagnosis of

26  Alzheimer's Disease which are played with the personal funds

27  of residents or clients must be supervised by paid or

28  volunteer staff. Prizes may be claimed only by residents or

29  clients of these facilities or by guests who are residents or

30  clients of other similarly licensed or authorized facilities.

31  Any net proceeds remaining after prizes are awarded may be

 1  donated by the residents' council to projects or activities of

 2  their choice. Any county or municipality that regulates the

 3  playing of bingo must exempt bingo games conducted pursuant to

 4  this section from regulation and fees.

 5         Section 2.  This act shall take effect July 1, 2003.

10  The Committee Substitute includes residents of government
    subsidized housing to the list of groups exempt from the
11  provisions of s. 849.0931, F.S., and granted permission to
    conduct bingo games at that facility.
