1 A bill to be entitled
2 An act relating to recreational activities at
3 facilities for elderly or disabled adults;
4 authorizing bingo games for residents or
5 clients of certain facilities for the elderly
6 or disabled and for their guests; providing
7 conditions; providing for use of proceeds;
8 providing exemption from local regulation and
9 fees; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Notwithstanding the provisions of section
14 849.0931, Florida Statutes, bingo games for residents or
15 clients of a facility licensed or authorized under part II,
16 part III, or part V of chapter 400, Florida Statutes, chapter
17 651, Florida Statutes, or section 430.206, Florida Statutes,
18 and for their guests, or for residents of government-financed,
19 government-insured, or government-subsidized housing for the
20 elderly and their guests, may be conducted if such games are
21 held in the facility, played exclusively by residents or
22 clients and their guests, and conducted by residents, staff,
23 or volunteers of the facility, and if neither the facility nor
24 any third party derives financial benefit from such games.
25 Games conducted in a facility licensed under part II, part
26 III, or part IV of chapter 400, Florida Statutes, for
27 residents or clients with a diagnosis of Alzheimer's disease
28 or a related dementia must not be played with the personal
29 funds of residents or clients and must be supervised by paid
30 or volunteer staff. Prizes may be claimed only by residents or
31 volunteer staff. Prizes may be claimed only by residents or

1 clients of these facilities or by guests who are residents or
2 clients of other similarly licensed or authorized facilities.
3 Net proceeds must be returned to players in the form of prizes
4 after expenses for refreshments and bingo supplies are
5 deducted. Any county or municipality that regulates the
6 playing of bingo must exempt bingo games conducted pursuant to
7 this section from regulation and fees.
8 Section 2. This act shall take effect July 1, 2003.

13 The committee substitute requires that bingo games played at
nursing homes, assisted living facilities, and home health
14 agencies may not be played with the personal funds of
residents with Alzheimer's disease.

In addition, the committee substitute requires that net
16 proceeds be returned to players in the form of prizes after
expenses for refreshments and bingo supplies are deducted.
