17          Section 1. Section 552.30, Florida Statutes, is amended to
18    read:
19          552.30 Construction materials mining activities.--
20          (1)Notwithstanding the provisions of s. 552.25, the State
21    Fire Marshal shall have the sole and exclusive authority to
22    promulgate standards, limits, and regulations regarding the use
23    of explosives in conjunction with construction materials mining
24    activities. Such authority to regulate use shall include,
25    directly or indirectly, the operation, handling, licensure, or
26    permitting of explosives and setting standards or limits,
27    including, but not limited to, ground vibration, frequency,
28    intensity, blast pattern, air blast and time, date, occurrence,
29    and notice restrictions. As used in this section, "construction
30    materials mining activities" means the extraction of limestone
31    and sand suitable for production of construction aggregates,
32    sand, cement, and road base materials for shipment offsiteby
33    any person or company primarily engaged in the commercial mining
34    of any such natural resources.
35          (2) The State Fire Marshal shall establish statewide
36    ground vibration limits for construction materials mining
37    activities which conform to those limits established in the
38    United States Bureau of Mines, Report of Investigations 8507,
39    Appendix B - Alternative Blasting Level Criteria (Figure B-1).
40    The State Fire Marshal may, at his or her sole discretion, by
41    rule or formal agreement, delegate to the applicable
42    municipality or county, the monitoring and enforcement
43    components of regulations governing the use of explosives, as
44    recognized in this section, by construction materials mining
45    activities. Such delegation may include the assessment and
46    collection of reasonable fees by the municipality or county for
47    the purpose of carrying out the delegated activities.
