  1                      A bill to be entitled

  2         An act relating to transportation; amending s.

  3         316.2952, F.S.; deleting a reference to an

  4         obsolete federal safety standard; amending ss.

  5         322.212 and 338.2216, F.S.; correcting

  6         references; amending s. 338.165, F.S.;

  7         authorizing the refinancing of certain

  8         transportation facilities; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Subsection (2) of section 316.2952, Florida

14  Statutes, is amended to read:

15         316.2952  Windshields; requirements; restrictions.--

16         (2)  A person shall not operate any motor vehicle on

17  any public highway, road, or street with any sign,

18  sunscreening material, product, or covering attached to, or

19  located in or upon, the windshield, except the following:

20         (a)  A certificate or other paper required to be

21  displayed by law.

22         (b)  Sunscreening material along a strip at the top of

23  the windshield, so long as such material is transparent and

24  does not encroach upon the driver's direct forward viewing

25  area as more particularly described and defined in Federal

26  Motor Vehicle Safety Standards Nos. 205 and 128 as the AS/1

27  portion of the windshield.

28         (c)  A device, issued by a governmental entity as

29  defined in s. 334.03, or its designee, for the purpose of

30  electronic toll payments.

 1         Section 2.  Subsection (1) of section 322.212, Florida

 2  Statutes, is amended to read:

 3         322.212  Unauthorized possession of, and other unlawful

 4  acts in relation to, driver's license or identification

 5  card.--

 6         (1)  It is unlawful for any person to:

 7         (a)  Knowingly have in his or her possession or to

 8  display any blank, forged, stolen, fictitious, counterfeit, or

 9  unlawfully issued driver's license or identification card or

10  any instrument in the similitude of a driver's license or

11  identification card unless possession by such person has been

12  duly authorized by the department;

13         (b)  Knowingly have in his or her possession any

14  instrument in the similitude of a driver's license issued by

15  the department or its duly authorized agents or those of any

16  state or jurisdiction issuing licenses recognized in this

17  state for the operation of a motor vehicle;

18         (c)  Knowingly have in his or her possession any

19  instrument in the similitude of an identification card issued

20  by the department or its duly authorized agents or those of

21  any state or jurisdiction issuing identification cards

22  recognized in this state for the purpose of indicating a

23  person's true name and age; or

24         (d)  Knowingly sell, manufacture, or deliver, or

25  knowingly offer to sell, manufacture, or deliver, a blank,

26  forged, stolen, fictitious, counterfeit, or unlawfully issued

27  driver's license or identification card, or an instrument in

28  the similitude of a driver's license or identification card,

29  unless that person is authorized to do so by the department. A

30  violation of this section paragraph may be investigated by any

 1  law enforcement agency, including the Division of Alcoholic

 2  Beverages and Tobacco.

 3  

 4  The term "driver's license" includes a driver's license issued

 5  by the department or its agents or a driver's license issued

 6  by any state or jurisdiction that issues licenses recognized

 7  in this state for the operation of a motor vehicle. The term

 8  "identification card" includes any identification card issued

 9  by the department or its agents or any identification card

10  issued by any state or jurisdiction that issues identification

11  cards recognized in this state for the purpose of indicating a

12  person's true name and age. This subsection does not prohibit

13  a person from possessing or displaying another person's

14  driver's license or identification card for a lawful purpose.

15         Section 3.  Subsection (3) of section 338.165, Florida

16  Statutes, is amended to read:

17         338.165  Continuation of tolls.--

18         (3)  Notwithstanding any other law to the contrary,

19  pursuant to s. 11, Art. VII of the State Constitution, and

20  subject to the requirements of subsection (2), the Department

21  of Transportation may request the Division of Bond Finance to

22  issue bonds secured by toll revenues collected on the

23  Alligator Alley, Sunshine Skyway Bridge, Beeline East

24  Expressway, and Pinellas Bayway to fund transportation

25  projects located within the county or counties in which the

26  facility is located and contained in the 1993-1994 Adopted

27  Work Program or in any subsequent adopted work program of the

28  department.

29         Section 4.  Paragraph (b) of subsection (1) of section

30  338.2216, Florida Statutes, is amended to read:

 1         338.2216  Florida Turnpike Enterprise; powers and

 2  authority.--

 3         (1)

 4         (b)  It is the express intention of the Florida

 5  Turnpike Law this part that the Florida Turnpike Enterprise be

 6  authorized to plan, develop, own, purchase, lease, or

 7  otherwise acquire, demolish, construct, improve, relocate,

 8  equip, repair, maintain, operate, and manage the Florida

 9  Turnpike System; to expend funds to publicize, advertise, and

10  promote the advantages of using the turnpike system and its

11  facilities; and to cooperate, coordinate, partner, and

12  contract with other entities, public and private, to

13  accomplish these purposes.

14         Section 5.  This act shall take effect upon becoming a

15  law.

18                          SENATE SUMMARY

19    Revises provisions relating to transportation to delete
      obsolete references and correct references. Authorizes
20    the refinancing of certain transportation facilities.
