2 An act relating to immunizations against
3 communicable diseases; amending s. 1003.22,
4 F.S.; requiring that children in certain
5 counties be immunized for hepatitis A and
6 encouraging their immunization in other
7 counties; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (3) of section 1003.22, Florida
12 Statutes, is amended to read:
13 1003.22 School-entry health examinations; immunization
14 against communicable diseases; exemptions; duties of
15 Department of Health.--
16 (3) The Department of Health may adopt rules necessary
17 to administer and enforce this section. The Department of
18 Health, after consultation with the Department of Education,
19 shall adopt rules governing the immunization of children
20 against, the testing for, and the control of preventable
21 communicable diseases. The rules must include procedures for
22 exempting a child from immunization requirements.
23 Immunizations shall be required for poliomyelitis, diphtheria,
24 rubeola, rubella, pertussis, mumps, tetanus, hepatitis A in
25 counties that have or have ever had an average annual rate of
26 hepatitis A of 20 per 100,000 residents, and other
27 communicable diseases as determined by rules of the Department
28 of Health. Immunizations for hepatitis A are encouraged in
29 counties that have or have ever had an average annual rate of
30 hepatitis A of 10 per 100,000 residents. The manner and
31 frequency of administration of the immunization or testing

1 shall conform to recognized standards of medical practice.
2 The Department of Health shall supervise and secure the
3 enforcement of the required immunization. Immunizations
4 required by this section shall be available at no cost from
5 the county health departments.
6 Section 2. This act shall take effect July 1, 2003.
