1 A bill to be entitled
2 An act relating to instructional materials for
3 K-12 public education; authorizing a pilot
4 program within specified counties to enable
5 selected school districts to realize cost
6 savings in the purchase of used instructional
7 materials; imposing requirements on the vendors
8 of such materials; absolving the state from
9 responsibility for certain financial losses;
10 requiring the Department of Education to report
11 to the Legislature; providing for future
12 repeal; providing an effective date.

14 Be It Enacted by the Legislature of the State of Florida:

16 Section 1. The Department of Education may conduct a
17 pilot program to enable selected school districts to realize
18 cost savings without loss of quality or availability for
19 individual students in the purchase of used instructional
20 materials. The school districts of Hernando County, Pasco
21 County, and Polk County may participate in the pilot program.
22 Charter schools in each school district are eligible to
23 participate. For purposes of the pilot program, the
24 Department of Education may waive the requirements of section
25 1006.37, Florida Statutes, relating to the requisition of
26 instructional materials from publisher depositories. When a
27 secondhand book dealer or other third-party book vendor
28 provides used adopted instructional materials to a school
29 district, the dealer or vendor must certify the availability
30 of the used instructional materials, provide the International
31 Standard Book Number of each of the used instructional

1 materials, and certify that the used instructional materials
2 are the most currently adopted, Florida-specific instructional
3 materials and conform to the Sunshine State Standards. This
4 state is not responsible for financial loss caused by the
5 school district's deviating from the requirements of section
6 1006.37, Florida Statutes. The Department of Education shall
7 submit to the President of the Senate and the Speaker of the
8 House of Representatives for consideration during the 2004
9 Regular Session a report of the cost savings to school
10 districts based on results of the pilot program. This section
11 is repealed July 1, 2006.
12 Section 2. This act shall take effect July 1, 2003.

17 Provides that the pilot program's purpose is to realize a cost
savings when purchasing instructional materials without a loss
18 of quality or the availability of materials to students.
19 Eliminates Hillsborough County as a pilot program and adds
Polk County.

Allows, rather than requires, school districts to participate
21 in the pilot program.
22 Requires a secondhand book dealer or a third-party book vendor
who provides used materials to a school district to certify
23 specific information about the materials.
24 Provides that the state is not responsible for a financial
loss resulting from the use of a waiver.

Provides for the repeal of the pilot program on July 1, 2006.
