1 A bill to be entitled
2 An act relating to instructional materials for
3 K-12 public education; authorizing the Council
4 for Education Policy Research and Improvement
5 to conduct a pilot program within specified
6 counties to enable selected school districts to
7 realize cost savings in the purchase of used
8 instructional materials; imposing requirements
9 on the vendors of such materials; absolving the
10 state from responsibility for certain financial
11 losses; requiring a report to the Legislature;
12 providing for future repeal; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Notwithstanding the provisions of section
18 1006.37, Florida Statutes, the Council for Education Policy
19 Research and Improvement may conduct a pilot program to enable
20 selected school districts to realize cost savings without loss
21 of quality or availability for individual students in the
22 purchase of used instructional materials. The school
23 districts of Hernando County, Pasco County, and Polk County
24 may participate in the pilot program. Charter schools in each
25 school district are eligible to participate. When a secondhand
26 book dealer or other third-party book vendor provides used
27 adopted instructional materials to a school district, the
28 dealer or vendor must certify the availability of the used
29 instructional materials, provide the International Standard
30 Book Number of each of the used instructional materials, and
31 certify that the used instructional materials are not samples

1 or first printings and are the most currently adopted,
2 Florida-specific instructional materials and conform to the
3 Sunshine State Standards. This state is not responsible for
4 financial loss caused by the school district's deviating from
5 the requirements of section 1006.37, Florida Statutes. The
6 Council for Education Policy Research and Improvement shall
7 submit to the President of the Senate and the Speaker of the
8 House of Representatives for consideration during the 2004
9 Regular Session a report of the cost savings to school
10 districts based on results of the pilot program. This section
11 is repealed July 1, 2006.
12 Section 2. This act shall take effect July 1, 2003.

14 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
15 CS for Senate Bill 716

17 The CS for the CS directs the completion of the pilot project
by the Council for Education Policy Research and Improvement
18 instead of the Department of Education. It provides an
exception to the procurement of instructional materials
19 specified in s. 1006.37 to correct an invalid delegation of
legislative powers, and provides that the procured materials
20 not be samples or first printings.
