1 A bill to be entitled
2 An act relating to instructional materials for
3 K-12 public education; authorizing the
4 Department of Education to conduct a pilot
5 program; authorizing a pilot program within
6 specified counties to enable selected school
7 districts to realize cost savings in the
8 purchase of used instructional materials;
9 imposing requirements on the vendors of such
10 materials; absolving the state from
11 responsibility for certain financial losses;
12 requiring the Council for Education Policy
13 Research and Improvement to report to the
14 Legislature; providing for future repeal;
15 providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Notwithstanding the provisions of section
20 1006.37, Florida Statutes, the Department of Education may
21 conduct a pilot program to enable selected school districts to
22 realize cost savings without loss of quality or availability
23 for individual students in the purchase of used instructional
24 materials. The school districts of Hernando County, Pasco
25 County, and Polk County may participate in the pilot program.
26 Charter schools in such school districts shall be eligible to
27 participate in the pilot program. When a secondhand book
28 dealer or other third-party book vendor provides used adopted
29 instructional materials to a school district, the dealer or
30 vendor must certify the availability of the used instructional
31 materials, provide the International Standard Book Number of

1 each of the used instructional materials, and certify that
2 such materials are not samples or first printings, are the
3 most currently adopted, Florida-specific instructional
4 materials, and that the materials conform to the Sunshine
5 State Standards. The state is not responsible for financial
6 loss caused by the school district's deviating from the
7 requirements of section 1006.37, Florida Statutes. The Council
8 for Education Policy Research and Improvement shall submit to
9 the President of the Senate and the Speaker of the House of
10 Representatives for consideration during the 2004 Regular
11 Session a report of the cost savings to school districts based
12 on results of the pilot program. This section is repealed July
13 1, 2006.
14 Section 2. This act shall take effect July 1, 2003.

19 The committee substitute changes the Council for Education
Policy Research and Improvement to the Department of Education
20 as the entity authorized to conduct a pilot program.
