1 A bill to be entitled
2          An act relating to health care practice parameters;
3    repealing ss. 408.02 and 440.13(15), F.S., to delete the
4    requirement that the Agency for Health Care Administration
5    develop, endorse, and implement health care practice
6    parameters; amending ss. 440.134, 627.6418, and 627.6613,
7    F.S., relating to workers' compensation managed care plans
8    and health insurance policy coverage for mammograms;
9    removing references and legislative intent, to conform;
10    providing an effective date.
11         
12          Be It Enacted by the Legislature of the State of Florida:
13         
14          Section 1. Section 408.02, Florida Statutes, and
15    subsection (15) of section 440.13, Florida Statutes, are
16    repealed.
17          Section 2. Subsection (11) of section 440.134, Florida
18    Statutes, is amended to read:
19          440.134 Workers' compensation managed care arrangement.--
20          (11) A description of the use of any applicableworkers'
21    compensation practice parameters for health care services when
22    adopted by the agency.
23          Section 3. Subsection (1) of section 627.6418, Florida
24    Statutes, is amended to read:
25          627.6418 Coverage for mammograms.--
26          (1) An accident or health insurance policy issued,
27    amended, delivered, or renewed in this state must provide
28    coverage for at least the following:
29          (a) A baseline mammogram for any woman who is 35 years of
30    age or older, but younger than 40 years of age.
31          (b) A mammogram every 2 years for any woman who is 40
32    years of age or older, but younger than 50 years of age, or more
33    frequently based on the patient's physician's recommendation.
34          (c) A mammogram every year for any woman who is 50 years
35    of age or older.
36          (d) One or more mammograms a year, based upon a
37    physician's recommendation, for any woman who is at risk for
38    breast cancer because of a personal or family history of breast
39    cancer, because of having a history of biopsy-proven benign
40    breast disease, because of having a mother, sister, or daughter
41    who has or has had breast cancer, or because a woman has not
42    given birth before the age of 30.

44          It is the intent of the Legislature that, when practice
45    parameters for the delivery of mammography services are
46    developed pursuant to s. 408.02(7), the Legislature review the
47    requirements of this section and conform to the practice
48    parameters.
49          Section 4. Subsection (1) of section 627.6613, Florida
50    Statutes, is amended to read:
51          627.6613 Coverage for mammograms.--
52          (1) A group, blanket, or franchise accident or health
53    insurance policy issued, amended, delivered, or renewed in this
54    state must provide coverage for at least the following:
55          (a) A baseline mammogram for any woman who is 35 years of
56    age or older, but younger than 40 years of age.
57          (b) A mammogram every 2 years for any woman who is 40
58    years of age or older, but younger than 50 years of age, or more
59    frequently based on the patient's physician's recommendation.
60          (c) A mammogram every year for any woman who is 50 years
61    of age or older.
62          (d) One or more mammograms a year, based upon a
63    physician's recommendation, for any woman who is at risk for
64    breast cancer because of a personal or family history of breast
65    cancer, because of having a history of biopsy-proven benign
66    breast disease, because of having a mother, sister, or daughter
67    who has or has had breast cancer, or because a woman has not

73    requirements of this section and conform to the practice

75          Section 5. This act shall take effect upon becoming a law.
