6          The Committee on Health Care recommends the following:

9          Remove the entire bill and insert:
10 A bill to be entitled
11          An act relating to health care practice parameters;
12    repealing ss. 408.02 and 440.13(15), F.S., to delete the
13    requirement that the Agency for Health Care Administration
14    develop, endorse, and implement health care practice
15    parameters; amending ss. 440.134, 627.6418, and 627.6613,
16    F.S., relating to workers' compensation managed care plans
17    and health insurance policy coverage for mammograms;
18    removing references and revising legislative intent, to
19    conform; providing an effective date.
20         
21          Be It Enacted by the Legislature of the State of Florida:
22         
23          Section 1. Section 408.02, Florida Statutes, and
24    subsection (15) of section 440.13, Florida Statutes, are
25    repealed.
26          Section 2. Subsection (11) of section 440.134, Florida
27    Statutes, is amended to read:
28          440.134 Workers' compensation managed care arrangement.--
29          (11) A description of the use of any applicableworkers'
30    compensation practice parameters for health care services when
31    adopted by the agency.
32          Section 3. Subsection (1) of section 627.6418, Florida
33    Statutes, is amended to read:
34          627.6418 Coverage for mammograms.--
35          (1) An accident or health insurance policy issued,
36    amended, delivered, or renewed in this state must provide
37    coverage for at least the following:
38          (a) A baseline mammogram for any woman who is 35 years of
39    age or older, but younger than 40 years of age.
40          (b) A mammogram every 2 years for any woman who is 40
41    years of age or older, but younger than 50 years of age, or more
42    frequently based on the patient's physician's recommendation.
43          (c) A mammogram every year for any woman who is 50 years
44    of age or older.
45          (d) One or more mammograms a year, based upon a
46    physician's recommendation, for any woman who is at risk for
47    breast cancer because of a personal or family history of breast
48    cancer, because of having a history of biopsy-proven benign
49    breast disease, because of having a mother, sister, or daughter
50    who has or has had breast cancer, or because a woman has not
51    given birth before the age of 30.

53          It is the intent of the Legislature that the requirements of
54    this section conform to the practice parameters relating to
55    mammograms as recognized by the U.S. Agency for Healthcare
56    Research and Quality, when practice parameters for the delivery
57    of mammography services are developed pursuant to s. 408.02(7),
58    the Legislature review the requirements of this section and
59    conform to the practice parameters.
60          Section 4. Subsection (1) of section 627.6613, Florida
61    Statutes, is amended to read:
62          627.6613 Coverage for mammograms.--
63          (1) A group, blanket, or franchise accident or health
64    insurance policy issued, amended, delivered, or renewed in this
65    state must provide coverage for at least the following:
66          (a) A baseline mammogram for any woman who is 35 years of
67    age or older, but younger than 40 years of age.
68          (b) A mammogram every 2 years for any woman who is 40
69    years of age or older, but younger than 50 years of age, or more
70    frequently based on the patient's physician's recommendation.
71          (c) A mammogram every year for any woman who is 50 years
72    of age or older.
73          (d) One or more mammograms a year, based upon a
74    physician's recommendation, for any woman who is at risk for
75    breast cancer because of a personal or family history of breast
76    cancer, because of having a history of biopsy-proven benign
77    breast disease, because of having a mother, sister, or daughter
78    who has or has had breast cancer, or because a woman has not
