Right-to-Know Act; amending s. 252.85, F.S.; providing a |

fee for all, rather than just certain, reports or filings |

required by section 313 of the Emergency Planning and |

Community Right-to-Know Act; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
|

Section 1. Subsection (3) of section 252.85, Florida |
|
11
|
Statutes, is amended to read: |
|

|
252.85 Fees.-- |
|
13
|
(3) Any owner or operator of a facility that is required |
|
14
|
to submit a report or filing under s. 313 of EPCRA shall pay an |
|
15
|
annual reporting fee not to exceed $150 for those s. 313 EPCRA |
|
16
|
listed substances in effect on January 1, 1998. The department |
|
17
|
shall establish by rule the date by which the fee is to be paid, |
|
18
|
as well as a formula or method of determining the applicable fee |
|
19
|
under this subsection. |

Section 2. This act shall take effect July 1, 2003. |
