amending s. 934.03, F.S.; making lawful certain |

interceptions by investigative or law enforcement officers |

of certain communications; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

Section 1. Paragraph (c) of subsection (2) of section |
10
|
934.03, Florida Statutes, is amended to read: |
11
|
934.03 Interception and disclosure of wire, oral, or |
12
|
electronic communications prohibited.-- |

|
(2) |

(c) It is lawful under ss. 934.03-934.09 for an |
15
|
investigative or law enforcement officer or a person acting |
16
|
under the direction of an investigative or law enforcement |
17
|
officer to intercept a wire, oral, or electronic communication |
18
|
when such person is a party to the communication or one of the |
19
|
parties to the communication has given prior consent to such |
20
|
interception and the purpose of such interception is related to |
21
|
the investigation of any felony, misdemeanor, or noncriminal |
22
|
violation the officer is authorized by law to enforceto obtain |
23
|
evidence of a criminal act. |

|
Section 2. This act shall take effect upon becoming a law. |
