boundaries; creating s. 290.00679, F.S.; authorizing the |

amendment of the boundaries of certain rural enterprise |
|
19
|
zones after recommendation of Enterprise Florida, Inc., |
|
20
|
and upon recommendation of the local development agency; |
|
21
|
creating s. 290.00684, F.S.; authorizing Escambia County |
|
22
|
to apply to the Office of Tourism, Trade, and Economic |
|
23
|
Development for designation of one enterprise zone, |
|
24
|
notwithstanding certain limitations; providing |
|
25
|
requirements with respect thereto; providing an effective |
|
26
|
date. |

Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|
30
|
Section 1. Section 290.00675, Florida Statutes, is amended |
|
31
|
to read: |
|
32
|
290.00675 Amendment of certain enterprise zone |
|
33
|
boundaries.--Notwithstanding any other provisions of law, the |
|
34
|
Office of Tourism, Trade, and Economic Development may amend the |
|
35
|
boundaries of an area designated as an enterprise zone in a |
|
36
|
community having a population of 235,000 persons but less than |
|
37
|
260,000245,000, so long as the area does not increase the |
|
38
|
overall size of the zone by greater than 25 acres and the |
|
39
|
increased area is contiguous to the existing enterprise zone. |
|
40
|
The amendment must also be consistent with the limitations |
|
41
|
imposed by s. 290.0055 upon establishment of the enterprise |
|
42
|
zone. |

Section 2. Subsection (3) of section 290.00676, Florida |
|
44
|
Statutes, is amended to read: |
|

|

|

|
boundaries.--Notwithstanding any other law, upon recommendation |
|
47
|
by Enterprise Florida, Inc., the Office of Tourism, Trade, and |
|
48
|
Economic Development may approve requests to amend the |
|

|
boundaries of rural enterprise zones as defined in s. |
|
50
|
290.004(8). Boundary amendments authorized by this section are |
|
51
|
subject to the following requirements: |
|

|
(3) The local enterprise zone development agency must |
|
53
|
request the amendment from Enterprise Florida, Inc., prior to |
|
54
|
December 30, 20032001. The request must contain maps and |
|
55
|
sufficient information to allow the office to determine the |
|
56
|
number of noncontiguous areas and the total size of the rural |
|
57
|
enterprise zone. |

Section 3. Section 290.00679, Florida Statutes, is created |
|
59
|
to read: |
|

|
290.00679 Amendment to certain rural enterprise zone |
|
61
|
boundaries.--Notwithstanding any other law, upon recommendation |
|
62
|
by Enterprise Florida, Inc., the Office of Tourism, Trade, and |
|
63
|
Economic Development may approve requests to amend the |
|
64
|
boundaries of rural enterprise zones as defined in s. |
|
65
|
290.004(8). Boundary amendments authorized by this section are |
|
66
|
subject to the following requirements: |
|

|
(1) The amendment may increase the size of the rural |
|
68
|
enterprise zone up to a maximum zone size of 20 square miles. |
|
69
|
(2) For purposes of this section, the pervasive poverty |
|
70
|
criterion may be set aside.
|
|

|
(3) The local enterprise zone development agency must |
|
72
|
request the amendment from Enterprise Florida, Inc., before |
|
73
|
December 31, 2003. The request must contain maps and sufficient |
|
74
|
information to allow the office to determine the total size of |
|
75
|
the rural enterprise zone. |
|

Section 4. Section 290.00684, Florida Statutes, is created |
|
77
|
to read: |
|

|
290.00684 Enterprise zone designation for Escambia |
|
79
|
County.--Escambia County may apply to the Office of Tourism, |
|
80
|
Trade, and Economic Development for designation of one |
|
81
|
enterprise zone within the county encompassing an area which |
|
82
|
shall not exceed 20 square miles and shall have a contiguous |
|
83
|
boundary or shall consist of not more than three noncontiguous |
|
84
|
areas. The application must be submitted by December 31, 2003, |
|
85
|
and must comply with the requirements of s. 290.0055, except |
|
86
|
subsection (3) of that section. Notwithstanding the provisions |
|
87
|
of s. 290.0065 limiting the total number of enterprise zones |
|
88
|
designated and the number of enterprise zones within a |
|
89
|
population category, the Office of Tourism, Trade, and Economic |
|
90
|
Development may designate one enterprise zone under this |
|
91
|
section. The Office of Tourism, Trade, and Economic Development |
|
92
|
shall establish the initial effective date of the enterprise |
|
93
|
zone designated pursuant to this section. |
|

|
Section 5. This act shall take effect upon becoming a law. |
