2 An act relating to trust funds; terminating and
3 re-creating the Workers' Compensation
4 Administration Trust Fund within the Department
5 of Education without modification; carrying
6 forward current balances and continuing current
7 sources and uses thereof; repealing s.
8 1010.87(3), F.S.; abrogating provisions
9 relating to the termination of the trust fund,
10 to conform; providing an effective date.

12 WHEREAS, the Legislature wishes to extend the life of
13 the Workers' Compensation Administration Trust Fund within the
14 Department of Education, which is otherwise scheduled to be
15 terminated pursuant to constitutional mandate, and
16 WHEREAS, the Legislature has reviewed the trust fund
17 before its scheduled termination date and has found that it
18 continues to meet an important public purpose, and
19 WHEREAS, the Legislature has found that existing public
20 policy concerning the trust fund sets adequate parameters for
21 its use, NOW, THEREFORE,

23 Be It Enacted by the Legislature of the State of Florida:

25 Section 1. (1) The Workers' Compensation
26 Administration Trust Fund within the Department of Education,
27 FLAIR number 48-2-795, which is to be terminated pursuant to
28 Section 19(f), Article III of the State Constitution on July
29 1, 2006, unless terminated sooner by law, is terminated on
30 November 4, 2004, and re-created.

1 (2) All current balances of the trust fund are carried
2 forward, and all current sources and uses of the trust fund
3 are continued.
4 Section 2. Subsection (3) of section 1010.87, Florida
5 Statutes, as created by section 1 of chapter 2002-398, Laws of
6 Florida, is repealed.
7 Section 3. This act shall take effect November 4,
8 2004.
