Section 8. Paragraph (j) is added to subsection (2) of |
17
|
section 471.003, Florida Statutes, to read: |

|
471.003 Qualifications for practice; exemptions.-- |
19
|
(2) The following persons are not required to be licensed |
20
|
under the provisions of this chapter as a licensed engineer: |
21
|
(j) Any employee or contractor of a sole proprietorship, |
22
|
firm, limited liability company, partnership, joint stock |
23
|
association, corporation, or other business entity that:
|
24
|
1. Provides products, services, or a project as defined in |
25
|
s. 288.1045(1)(i) to an agency or department of the United |
26
|
States, or any agency or department of a state government, or |
27
|
the government of a foreign country which involves the design, |
28
|
development, production, sales, or provision of defense or |
29
|
aerospace products or services;
|
30
|
2. Consists of or supports commercial aircraft and the |
31
|
entity holds a certificate issued by the Federal Aviation |
32
|
Administration under Chapter 21, Title 14, of the Code of |
33
|
Federal Regulations;
|
34
|
3. Consists of space vehicles or space services that are |
35
|
subject to licensing or regulation by an agency or department of |
36
|
the United States under Title 14, Title 47, or Title 48 of the |
37
|
Code of Federal Regulations or are for sale or use outside the |
38
|
United States; or
|
39
|
4. Prohibits the use of the term "engineer" or |
40
|
"engineering" in a job title or personnel classification by an |
41
|
employee or contractor to the extent that the use of the title |
42
|
or classification is related to activities described in this |
43
|
paragraph.

This paragraph is repealed July 1, 2004, unless reenacted or |
46
|
amended by the Legislature.

Section 9. Subsection (3) is added to section 471.031, |
48
|
Florida Statutes, to read: |

|
471.031 Prohibitions; penalties.-- |
50
|
(3) Notwithstanding any other provision of this chapter, a |
51
|
person who is not required to be licensed pursuant to s. |
52
|
471.003(2) and who is employed by an entity not offering |
53
|
engineering services to the public may use the title "engineer" |
54
|
or any title listed in paragraph (1)(b), except "professional |
55
|
engineer," "licensed engineer," or "registered engineer," so |
56
|
long as such use does not indicate that the person is duly |
57
|
licensed and is authorized to practice engineering beyond the |
58
|
scope of the exemptions set forth in s. 471.003(2). This |
59
|
subsection is repealed July 1, 2004, unless reenacted or amended |
60
|
by the Legislature.
