purposes; requiring the association to file certain |

information with the Department of Financial Services; |

providing a limitation relating to method of service of |

process; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|

Section 1. Subsection (6) is added to section 627.311, |
15
|
Florida Statutes, to read: |
16
|
627.311 Joint underwriters and joint reinsurers.-- |
17
|
(6)(a) The Florida Automobile Joint Underwriting |
18
|
Association created under this section shall be deemed to have |
19
|
appointed the Chief Financial Officer and his or her successors |
20
|
in office as its agent to receive service of all legal process |
21
|
issued against it in any civil action or proceeding in this |
22
|
state. Process so served shall be valid and binding upon the |
23
|
insurer.

(b) The association shall file with the Department of |
25
|
Financial Services a designation of the name and address of the |
26
|
person to whom process against it served upon the Chief |
27
|
Financial Officer is to be forwarded. The association may change |
28
|
the designation at any time by a new filing.
|

|
(c) Service of process upon the Chief Financial Officer as |
30
|
the association’s agent pursuant to such an appointment shall be |
31
|
the sole method of service of process upon the association.
|

Section 2. This act shall take effect upon becoming a law. |
