the state; providing a freeze on management/administration |

|
positions; providing for future repeal; providing an |
9
|
effective date. |

Be It Enacted by the Legislature of the State of Florida: |
12
|
|

|
Section 1.Law Enforcement Agency Consolidation Task |
14
|
Force.-- |
15
|
(1)(a) There is created within the Executive Office of the |
16
|
Governor the Law Enforcement Agency Consolidation Task Force. |
17
|
Members of the task force shall be appointed no later than July |
18
|
10, 2003. The task force shall be composed of: |
19
|
1. Two representatives from private industry who have |
20
|
expertise in corporate mergers, appointed by the Governor; |
21
|
2. The Attorney General or his or her designee; |
22
|
3. A member of the Senate, appointed by the President of |
23
|
the Senate; and |
24
|
4. A member of the House of Representatives, appointed by |
25
|
the Speaker of the House of Representatives. |

|
(b) The first meeting of the task force shall be held no |
27
|
later than July 15, 2003, at which time the members shall select |
28
|
by majority vote a chair from among its members. All other |
29
|
recommendations of the task force shall be by majority vote of |
30
|
those members in attendance. Three members of the task force |
31
|
shall constitute a quorum. The task force is subject to the |
32
|
requirements of chapter 119, Florida Statutes. All meetings of |
33
|
the task force shall be in accordance with s. 286.011, Florida |
34
|
Statutes, and the public in attendance at any meeting shall be |
35
|
given the opportunity to participate. The Executive Office of |
36
|
the Governor shall ensure that those persons who request |
37
|
notification of the time and place of any meeting of the task |
38
|
force, including its initial meeting, shall receive such notice |
39
|
in a timely fashion. |

(c) Members of the task force shall serve without |
41
|
compensation. Members are entitled to reimbursement for per |
42
|
diem and travel expenses in accordance with s. 112.061, Florida |
43
|
Statutes. |

|
(d) The Executive Office of the Governor shall provide |
45
|
staff support for the task force within existing appropriations. |

|
(2)(a) The task force shall meet for the purpose of |
47
|
studying the effects of consolidating law enforcement and/or |
48
|
commission functions in state agencies under a unified command. |
49
|
The task force shall submit a preliminary report of its |
50
|
findings and recommendations to the Governor, the President of |
51
|
the Senate, and the Speaker of the House of Representatives no |
52
|
later than 45 days prior to the first day of the 2004 Regular |
53
|
Session of the Legislature. The final report shall be filed |
54
|
with the Governor, the President of the Senate, and the Speaker |
55
|
of the House of Representatives no later than 30 days prior to |
56
|
the first day of the 2004 Regular Session of the Legislature. |

|
(b) The preliminary and final report shall: |
58
|
1. Identify all law enforcement functions and duties of |
59
|
personnel positions that exist in each state agency; |
60
|
2. Identify all statutory provisions assigning law |
61
|
enforcement duties to state agencies; |
62
|
3. Identify the options considered by the task force for |
63
|
consolidation of state law enforcement functions, duties, and |
64
|
personnel and identify costs for consolidation under each option |
65
|
considered; |
66
|
4. Determine whether consolidation of any law enforcement |
67
|
functions or law enforcement personnel, or both, would prove |
68
|
more effective and efficient. Such determination shall include |
69
|
a cost analysis and comparison, with supporting analysis; and |
70
|
5. If the determination is made that consolidation is more |
71
|
effective and efficient, recommend proposed legislation based |
72
|
upon the recommended best option for consolidating any law |
73
|
enforcement functions or law enforcement personnel, or both. |

|
Such proposed legislation shall include, but not be limited to, |
75
|
provision for any necessary restructuring of agencies as a |
76
|
result of the recommended reorganization. |

|
(3)(a) Each state agency shall fully cooperate with the |
78
|
task force in the performance of its duties under this section. |

|
(b) Each agency that has been assigned law enforcement |
80
|
functions or which employs sworn law enforcement personnel shall |
81
|
provide a report to the task force that identifies each section |
82
|
of law upon which that agency relies for authority to perform |
83
|
law enforcement functions and to employ sworn law enforcement |
84
|
officers. This report shall be submitted to the task force no |
85
|
later than August 1, 2003. |

|
(4) All management/administration positions vacant on the |
87
|
effective date of this act, are hereby frozen until the |
88
|
recommendations of the commission are acted upon. |
89
|
(5) The task force shall sunset on July 1, 2004. |
90
|
Section 2. This act shall take effect upon becoming a law. |
