| 11 | An act relating to law enforcement; creating the Law | ||
| 12 | Enforcement Agency Consolidation Task Force; providing for | ||
| 13 | the appointment of members; providing for duties; | ||
| 14 | providing for a report addressing the effects of the | ||
| 15 | consolidation of all sworn law enforcement positions in | ||
| 16 | the state; providing for future repeal; providing an | ||
| 17 | effective date. | ||

| 19 | Be It Enacted by the Legislature of the State of Florida: | ||
| 20 | |||
| 21 | Section 1. Law Enforcement Agency Consolidation Task | ||
| 22 | Force.-- | ||
| 23 | (1)(a) There is created within the Executive Office of the | ||
| 24 | Governor the Law Enforcement Agency Consolidation Task Force. | ||
| 25 | Members of the task force shall be appointed no later than July | ||
| 26 | 10, 2003. The task force shall be composed of: | ||
| 27 | 1. Two representatives from private industry who have | ||
| 28 | expertise in corporate mergers, appointed by the Governor; | ||
| 29 | 2. The Attorney General or his or her designee; | ||
| 30 | 3. A member of the Senate, appointed by the President of | ||
| 31 | the Senate; and | ||
| 32 | 4. A member of the House of Representatives, appointed by | ||
| 33 | the Speaker of the House of Representatives. | ||
| 34 | (b) The first meeting of the task force shall be held no | ||
| 35 | later than July 15, 2003, at which time the members shall select | ||
| 36 | by majority vote a chair from among its members. All other | ||
| 37 | recommendations of the task force shall be by majority vote of | ||
| 38 | those members in attendance. Three members of the task force | ||
| 39 | shall constitute a quorum. The task force is subject to the | ||
| 40 | requirements of chapter 119, Florida Statutes. All meetings of | ||
| 41 | the task force shall be in accordance with s. 286.011, Florida | ||
| 42 | Statutes, and the public in attendance at any meeting shall be | ||
| 43 | given the opportunity to participate. The Executive Office of | ||
| 44 | the Governor shall ensure that those persons who request | ||
| 45 | notification of the time and place of any meeting of the task | ||
| 46 | force, including its initial meeting, shall receive such notice | ||
| 47 | in a timely fashion. | ||
| 48 | (c) Members of the task force shall serve without | ||
| 49 | compensation. Members are entitled to reimbursement for per | ||
| 50 | diem and travel expenses in accordance with s. 112.061, Florida | ||
| 51 | Statutes. | ||
| 52 | (d) The Executive Office of the Governor shall provide | ||
| 53 | staff support for the task force within existing appropriations. | ||
| 54 | (2)(a) The task force shall meet for the purpose of | ||
| 55 | studying the effects of consolidating law enforcement and/or | ||
| 56 | commission functions in state agencies under a unified command. | ||
| 57 | The task force shall submit a preliminary report of its findings | ||
| 58 | and recommendations to the Governor, the President of the | ||
| 59 | Senate, and the Speaker of the House of Representatives no later | ||
| 60 | than 45 days prior to the first day of the 2004 Regular Session | ||
| 61 | of the Legislature. The final report shall be filed with the | ||
| 62 | Governor, the President of the Senate, and the Speaker of the | ||
| 63 | House of Representatives no later than 30 days prior to the | ||
| 64 | first day of the 2004 Regular Session of the Legislature. | ||
| 65 | (b) The preliminary and final report shall: | ||
| 66 | 1. Identify all law enforcement functions and duties of | ||
| 67 | personnel positions that exist in each state agency; | ||
| 68 | 2. Identify all statutory provisions assigning law | ||
| 69 | enforcement duties to state agencies; | ||
| 70 | 3. Identify the options considered by the task force for | ||
| 71 | consolidation of state law enforcement functions, duties, and | ||
| 72 | personnel and identify costs for consolidation under each option | ||
| 73 | considered; | ||
| 74 | 4. Determine whether consolidation of any law enforcement | ||
| 75 | functions or law enforcement personnel, or both, would prove | ||
| 76 | more effective and efficient. Such determination shall include | ||
| 77 | a cost analysis and comparison, with supporting analysis; and | ||
| 78 | 5. If the determination is made that consolidation is more | ||
| 79 | effective and efficient, recommend proposed legislation based | ||
| 80 | upon the recommended best option for consolidating any law | ||
| 81 | enforcement functions or law enforcement personnel, or both. | ||
| 82 | Such proposed legislation shall include, but not be limited to, | ||
| 83 | provision for any necessary restructuring of agencies as a | ||
| 84 | result of the recommended reorganization. | ||
| 85 | (3)(a) Each state agency shall fully cooperate with the | ||
| 86 | task force in the performance of its duties under this section. | ||
| 87 | (b) Each agency that has been assigned law enforcement | ||
| 88 | functions or which employs sworn law enforcement personnel shall | ||
| 89 | provide a report to the task force that identifies each section | ||
| 90 | of law upon which that agency relies for authority to perform | ||
| 91 | law enforcement functions and to employ sworn law enforcement | ||
| 92 | officers. This report shall be submitted to the task force no | ||
| 93 | later than August 1, 2003. | ||
| 94 | (4) The task force shall sunset on July 1, 2004. | ||
| 95 | Section 2. This act shall take effect upon becoming a law. | ||
