1 A bill to be entitled
2          An act relating to law enforcement; creating the Law
3    Enforcement Agency Consolidation Task Force; providing for
4    the appointment of members; providing for duties;
5    providing for a report addressing the effects of the
6    consolidation of all sworn law enforcement positions in
7    the state; providing for future repeal; providing an
8    effective date.

10          Be It Enacted by the Legislature of the State of Florida:
11         
12          Section 1. Law Enforcement Agency Consolidation Task
13    Force.--
14          (1)(a) There is created within the Executive Office of the
15    Governor the Law Enforcement Agency Consolidation Task Force.
16    Members of the task force shall be appointed no later than July
17    10, 2003. The task force shall be composed of:
18          1. Two representatives from private industry who have
19    expertise in corporate mergers, appointed by the Governor;
20          2. The Attorney General or his or her designee;
21          3. A member of the Senate, appointed by the President of
22    the Senate; and
23          4. A member of the House of Representatives, appointed by
24    the Speaker of the House of Representatives.
25          (b) The first meeting of the task force shall be held no
26    later than July 15, 2003, at which time the members shall select
27    by majority vote a chair from among its members. All other
28    recommendations of the task force shall be by majority vote of
29    those members in attendance. Three members of the task force
30    shall constitute a quorum. The task force is subject to the
31    requirements of chapter 119, Florida Statutes. All meetings of
32    the task force shall be in accordance with s. 286.011, Florida
33    Statutes, and the public in attendance at any meeting shall be
34    given the opportunity to participate. The Executive Office of
35    the Governor shall ensure that those persons who request
36    notification of the time and place of any meeting of the task
37    force, including its initial meeting, shall receive such notice
38    in a timely fashion.
39          (c) Members of the task force shall serve without
40    compensation. Members are entitled to reimbursement for per
41    diem and travel expenses in accordance with s. 112.061, Florida
42    Statutes.
43          (d) The Executive Office of the Governor shall provide
44    staff support for the task force within existing appropriations.
45          (2)(a) The task force shall meet for the purpose of
46    studying the effects of consolidating law enforcement and/or
47    commission functions in state agencies under a unified command.
48    The task force shall submit a preliminary report of its findings
49    and recommendations to the Governor, the President of the
50    Senate, and the Speaker of the House of Representatives no later
51    than 45 days prior to the first day of the 2004 Regular Session
52    of the Legislature. The final report shall be filed with the
53    Governor, the President of the Senate, and the Speaker of the
54    House of Representatives no later than 30 days prior to the
55    first day of the 2004 Regular Session of the Legislature.
56          (b) The preliminary and final report shall:
57          1. Identify all law enforcement functions and duties of
58    personnel positions that exist in each state agency;
59          2. Identify all statutory provisions assigning law
60    enforcement duties to state agencies;
61          3. Identify the options considered by the task force for
62    consolidation of state law enforcement functions, duties, and
63    personnel and identify costs for consolidation under each option
64    considered;
65          4. Determine whether consolidation of any law enforcement
66    functions or law enforcement personnel, or both, would prove
67    more effective and efficient. Such determination shall include
68    a cost analysis and comparison, with supporting analysis; and
69          5. If the determination is made that consolidation is more
70    effective and efficient, recommend proposed legislation based
71    upon the recommended best option for consolidating any law
72    enforcement functions or law enforcement personnel, or both.
73    Such proposed legislation shall include, but not be limited to,
74    provision for any necessary restructuring of agencies as a
75    result of the recommended reorganization.
76          (3)(a) Each state agency shall fully cooperate with the
77    task force in the performance of its duties under this section.
78          (b) Each agency that has been assigned law enforcement
79    functions or which employs sworn law enforcement personnel shall
80    provide a report to the task force that identifies each section
81    of law upon which that agency relies for authority to perform
82    law enforcement functions and to employ sworn law enforcement
83    officers. This report shall be submitted to the task force no
84    later than August 1, 2003.
85          (4) The task force shall sunset on July 1, 2004.
86          Section 2. This act shall take effect upon becoming a law.
