1 A bill to be entitled
2          An act relating to powers and duties of district school
3    boards; amending s. 1001.43, F.S.; authorizing district
4    school board programs and policies to provide for random
5    drug testing of high school student athletes; providing an
6    effective date.
7         
8          WHEREAS, the State of Florida considers providing a quality
9    education to its children the highest of priorities, and
10          WHEREAS, athletic competition is an integral part of the
11    educational process, providing personal challenges and
12    responsibility, skill in competition, teamwork cultivation, and
13    school pride, and
14          WHEREAS, the State of Florida has a compelling interest in
15    ensuring that children are educated and compete in a safe and
16    healthy environment, and
17          WHEREAS, the use of illicit drugs, performance enhancing
18    drugs, and certain prescription drugs is considered a health and
19    safety threat within Florida’s schools, playgrounds, and
20    athletic fields and forums, and
21          WHEREAS, studies and pilot projects have found a
22    significant curtailment of drug use among student athletes who
23    are subject to random drug testing, NOW, THEREFORE,
24         
25          Be It Enacted by the Legislature of the State of Florida:
26         
27          Section 1. Subsection (1) of section 1001.43, Florida
28    Statutes, is amended to read:
29          1001.43 Supplemental powers and duties of district school
30    board.--The district school board may exercise the following
31    supplemental powers and duties as authorized by this code or
32    State Board of Education rule.
33          (1) STUDENT MANAGEMENT.--The district school board may
34    adopt programs and policies to ensure the safety and welfare of
35    individuals, the student body, and school personnel, which
36    programs and policies may:
37          (a) Prohibit the possession of weapons and drugs on
38    campus, student hazing, and other activities that could threaten
39    the operation of the school or the safety and welfare of the
40    student body or school personnel.
41          (b) Permit random drug testing of high school student
42    athletes.
43          (c)(b)Require uniforms to be worn by the student body, or
44    impose other dress-related requirements, if the district school
45    board finds that those requirements are necessary for the safety
46    or welfare of the student body or school personnel.
47          (d)(c)Provide procedures for student dismissal
48    precautions and for granting permission for students to leave
49    school grounds during school hours, including releasing a
50    student from school upon request by a parent or for public
51    appearances of school groups.
52          (e)(d)Provide procedures for managing protests,
53    demonstrations, sit-ins, walk-outs, or other acts of civil
54    disobedience.
55          (f)(e)Provide procedures for detaining students and for
56    readmission of students after expulsion.
57          (g)(f)Regulate student automobile use and parking.
58          Section 2. This act shall take effect July 1, 2003.
