1 A bill to be entitled
2          An act relating to unemployment compensation hearings;
3    amending s. 443.151, F.S.; requiring that notice of the
4    hearing be sent to all parties by certified or registered
5    mail; providing an effective date.
6         
7          Be It Enacted by the Legislature of the State of Florida:
8         
9          Section 1. Paragraph (b) of subsection (4) of section
10    443.151, Florida Statutes, is amended to read:
11          443.151 Procedure concerning claims.--
12          (4) APPEALS.--
13          (b) Filing and hearing.--
14          1. The claimant or any other party entitled to notice of a
15    determination as herein provided may file an appeal from such
16    determination with an appeals referee within 20 days after the
17    date of mailing of the notice to her or his last known address
18    or, if such notice is not mailed, within 20 days after the date
19    of delivery of such notice.
20          2. Notwithstanding the provisions of s. 120.569(2)(b),
21    unless the appeal is withdrawn with her or his permission or is
22    removed to the commission, the appeals referee, after mailing
23    all parties and attorneys of record a notice of hearing by
24    certified or registered mailat least 10 days prior to the date
25    of hearing, shall affirm, modify, or reverse such determination;
26    however, whenever an appeal involves a question as to whether
27    services were performed by claimant in employment or for an
28    employer, the referee shall give special notice of such issue by
29    certified or registered mailand of the pendency of the appeal
30    to the employing unit and to the division, both of which shall
31    thenceforth be parties to the proceeding.
32          3. The parties shall be promptly notified of such
33    referee's decision; and such decisions shall be final unless,
34    within 20 days after the date of mailing of notice thereof to
35    the party's last known address or, in the absence of such
36    mailing, within 20 days after the delivery of such notice,
37    further review is initiated pursuant to paragraph (c).
38          Section 2. This act shall take effect July 1, 2003.
