| 1 | A bill to be entitled | ||
| 2 | An act relating to bankruptcy; prohibiting the sale or | ||
| 3 | disclosure of personal customer information by persons in | ||
| 4 | bankruptcy; authorizing actions for damages; providing an | ||
| 5 | effective date. | ||

| 7 | Be It Enacted by the Legislature of the State of Florida: | ||
| 8 | |||
| 9 | Section 1. (1) A person who files for bankruptcy may not | ||
| 10 | sell or otherwise transfer to another any database that contains | ||
| 11 | personal customer information if the bankrupt person, through | ||
| 12 | contract or a published privacy policy, agreed or stated that | ||
| 13 | personal customer information would not be disclosed. | ||
| 14 | (2) A person whose personal customer information is | ||
| 15 | disclosed in violation of this act may file an action for | ||
| 16 | damages against the person who disclosed such information. | ||
| 17 | Section 2. This act shall take effect July 1, 2003. | ||
