  1                      A bill to be entitled

  2         An act relating to trust funds; terminating and

  3         re-creating the Department of Business and

  4         Professional Regulation Tobacco Settlement

  5         Trust Fund within that department without

  6         modification; carrying forward current balances

  7         and continuing current sources and uses

  8         thereof; providing an effective date.

  9  

10         WHEREAS, the Legislature wishes to extend the life of

11  the Department of Business and Professional Regulation Tobacco

12  Settlement Trust Fund within that department, which is

13  otherwise scheduled to be terminated pursuant to

14  constitutional mandate, and

15         WHEREAS, the Legislature has reviewed the trust fund

16  before its scheduled termination date and has found that it

17  continues to meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the trust fund sets adequate parameters for

20  its use, NOW, THEREFORE,

21  

22  Be It Enacted by the Legislature of the State of Florida:

23  

24         Section 1.  (1)  The Department of Business and

25  Professional Regulation Tobacco Settlement Trust Fund within

26  that department, FLAIR number 79-2-122, which is to be

27  terminated pursuant to Section 19(f), Article III of the State

28  Constitution on July 1, 2007, unless terminated sooner by law,

29  is terminated on November 4, 2004, and re-created.

 1         (2)  All current balances of the trust fund are carried

 2  forward, and all current sources and uses of the trust fund

 3  are continued.

 4         Section 2.  This act shall take effect November 4,

 5  2004.

 8                          SENATE SUMMARY

 9    Terminates and re-creates the Department of Business and
      Professional Regulation Tobacco Settlement Trust Fund
10    within that department in order to synchronize its review
      cycle with other trust funds of the department.
