11          An act relating to K-20 education accountability; amending
12    s. 1008.31, F.S.; expanding legislative intent for the
13    K-20 education performance accountability system;
14    providing requirements and an implementation schedule for
15    performance-based funding; providing mission, goals, and
16    measures; requiring collection of certain data; requiring
17    the State Board of Education to conduct an assessment
18    study; authorizing adoption of equivalent scores for
19    purpose of graduation; providing an effective date.
20         
21          Be It Enacted by the Legislature of the State of Florida:
22         
23          Section 1. Section 1008.31, Florida Statutes, is amended
24    to read:
25          1008.31 Florida's K-20 education performance
26    accountability system; legislative intent; performance-based
27    funding; mission, goals, and systemwide measures.--
28          (1) LEGISLATIVE INTENT.--It is the intent of the
29    Legislature that:
30          (a) The performance accountability system implemented to
31    assess the effectiveness of Florida's seamless K-20 education
32    delivery system provide answers to the following questions in
33    relation to its mission and goals:
34          1. What is the public receiving in return for funds it
35    invests in education?
36          2. How effectively is Florida's K-20 education system
37    educating its students?
38          3. How effectively are the major delivery sectors
39    promoting student achievement?
40          4. How are individual schools and postsecondary education
41    institutions performing their responsibility to educate their
42    students as measured by how students are performing and how much
43    they are learning?
44          (b) The K-20 education performance accountability system
45    be established as a single, unified accountability system with
46    multiple components, including, but not limited to, measures of
47    adequate yearly progress, individual student learning gains in
48    public schools, school grades, and return on investment.
49          (c) The K-20 education performance accountability system
50    comply with the accountability requirements of the “No Child
51    Left Behind Act of 2001,” PL 107-110.
52          (d)(b)The State Board of Education recommend to the
53    Legislature systemwide performance standards; the Legislature
54    establish systemwide performance measures and standards; and the
55    systemwide measures and standards provide Floridians with
56    information on what the public is receiving in return for the
57    funds it invests in education and how well the K-20 system
58    educates its students.
59          (e)(c)The State Board of Education establish performance
60    measures and set performance standards for individual components
61    of the public education system, including individual schools and
62    postsecondary educational institutions, with measures and
63    standards based primarily on student achievement.
64          (2) PERFORMANCE-BASED FUNDING.--
65          (a) The State Board of Education shall cooperate with the
66    Commissioner of Education andeach delivery system to develop
67    proposals for performance-based funding, using performance
68    measures adopted pursuant to this sectionestablished by the
69    Legislature.
70          (b) The State Board of Educationproposals must provide
71    that at least 10 percent of the state funds appropriated for the
72    K-20 education system are conditional upon meeting or exceeding
73    established performance standards. The State Board of Education
74    must submit the recommendations to the Legislature in the
75    following sequence:
76          (a) By December 1, 2002, recommendations for state
77    universities, for consideration by the 2003 Legislature and
78    implementation in the 2003-2004 fiscal year.
79          (b) By December 1, 2003, recommendations for public
80    schools and workforce education, for consideration by the 2004
81    Legislature and implementation in the 2004-2005 fiscal year.
82          (c) By December 1, 2004, recommendations for community
83    colleges, for consideration by the 2005 Legislature and
84    implementation in the 2005-2006 fiscal year.
85          (d) By December 1, 2005, recommendations for all other
86    programs that receive state funds within the Department of
87    Education.
88          (c) The State Board of Education shall adopt guidelines
89    required to implement performance-based funding that allow 1
90    year to demonstrate achievement of specified performance
91    standards prior to a reduction in appropriations pursuant to
92    this section.
93          (d) By December 1, 2003, the State Board of Education
94    shall adopt common definitions, measures, standards, and
95    performance improvement targets required to:
96          1. Use the state core measures and the sector-specific
97    measures to evaluate the progress of each sector of the
98    educational delivery system toward meeting the systemwide goals
99    for public education.
100          2. Notify the sectors of their progress in achieving the
101    specified measures so that they may develop improvement plans
102    that directly influence decisions about policy, program
103    development, and management.
104          3. Implement the performance-based budgeting system
105    described in this section.
106          (e) During the 2003-2004 fiscal year, the Department of
107    Education shall collect data required to establish progress,
108    rewards, and sanctions.
109          (f) By December 1, 2004, the Department of Education shall
110    recommend to the Legislature a formula for performance-based
111    funding that applies accountability standards for the individual
112    components of the public education system at every level,
113    kindergarten through graduate school. Effective for the 2004-
114    2005 fiscal year and thereafter, subject to annual legislative
115    approval in the General Appropriations Act, performance-based
116    funds shall be allocated based on the progress, rewards, and
117    sanctions established pursuant to this section.
118          (3) MISSION, GOALS, AND SYSTEMWIDE MEASURES.--
119          (a)The mission of Florida's K-20 education system shall
120    be to increase the proficiency of all students within one
121    seamless, efficient system, by allowing them the opportunity to
122    expand their knowledge and skills through learning opportunities
123    and research valued by students, parents, and communities.
124          (b The State Board of Education shall adopt guiding
125    principles for establishing state and sector-specific standards
126    and measures.
127          (c) The State Board of Education shall, and tomaintain an
128    accountability system that measures student progress toward the
129    following goals:
130          1.(a)Highest student achievement, as measured by: student
131    FCAT performance and annual learning gains; the number and
132    percentage of schools that improve at least one school
133    performance grade designation or maintain a school performance
134    grade designation of "A" pursuant to s. 1008.34; graduation or
135    completion rates at all learning levels; and other measures
136    identified in law or rule.
137          2.(b)Seamless articulation and maximum access, as
138    measured by: the percentage of students who demonstrate
139    readiness for the educational level they are entering, from
140    kindergarten through postsecondary education and into the
141    workforce; the number and percentage of students needing
142    remediation; the percentage of Floridians who complete
143    associate, baccalaureate, graduate,professional, and
144    postgraduate degrees; the number and percentage of credits that
145    articulate; the extent to which each set of exit-point
146    requirements matches the next set of entrance-point
147    requirements; the degree to which underserved populations access
148    educational opportunity; the extent to which access is provided
149    through innovative educational delivery strategies;and other
150    measures identified in law or rule.
151          3.(c)Skilled workforce and economic development, as
152    measured by: the number and percentage of graduates employed in
153    their areas of preparation; the percentage of Floridians with
154    high school diplomas and postsecondary education credentials;
155    the percentage of business and community members who find that
156    Florida's graduates possess the skills they need; national
157    rankings;and other measures identified in law or rule.
158          4.(d)Quality efficient services, as measured by: cost per
159    completer or graduate; average cost per noncompleter at each
160    educational level; cost disparity across institutions offering
161    the same degrees; the percentage of education customers at each
162    educational level who are satisfied with the education provided;
163    and other measures identified in law or rule.
164          (4) SYSTEMWIDE DATA COLLECTION.--School districts and
165    public postsecondary educational institutions shall maintain
166    information systems that will provide the State Board of
167    Education and the Legislature with information and reports
168    necessary to address the specifications of the accountability
169    system. The State Board of Education shall determine the
170    standards for the required data. Theat alevel of
171    comprehensiveness and quality shall beno less than that which
172    was available as of June 30, 2001.
173          Section 2. The State Board of Education shall conduct a
174    concordance study to determine if crosswalk scores can be
175    determined to be equivalent to those required on the Florida
176    Comprehensive Assessment Test (FCAT) for high school graduation.
177    At a minimum, the state board shall analyze the PSAT, PLAN, SAT,
178    ACT, and the College Placement Test to determine if equivalent
179    scores can be determined. In cases where such equivalencies can
180    be determined, the state board is authorized to adopt those
181    scores as meeting the graduation requirement in lieu of the FCAT
182    passing score. Each time the score is changed, new equivalencies
183    must be determined. This provision shall take effect for
184    students who are eligible to graduate in the 2003-2004 academic
185    year and thereafter.
186          Section 3. This act shall take effect upon becoming a law.
