1 A bill to be entitled
2          An act relating to K-20 education accountability; amending
3    s. 1008.31, F.S.; expanding legislative intent for the
4    K-20 education performance accountability system;
5    providing requirements and an implementation schedule for
6    performance-based funding; providing mission, goals, and
7    measures; requiring collection of certain data; requiring
8    the State Board of Education to conduct an assessment
9    study; authorizing adoption of equivalent scores for
10    purpose of graduation; providing an effective date.
11         
12          Be It Enacted by the Legislature of the State of Florida:
13         
14          Section 1. Section 1008.31, Florida Statutes, is amended
15    to read:
16          1008.31 Florida's K-20 education performance
17    accountability system; legislative intent; performance-based
18    funding; mission, goals, and systemwide measures.--
19          (1) LEGISLATIVE INTENT.--It is the intent of the
20    Legislature that:
21          (a) The performance accountability system implemented to
22    assess the effectiveness of Florida's seamless K-20 education
23    delivery system provide answers to the following questions in
24    relation to its mission and goals:
25          1. What is the public receiving in return for funds it
26    invests in education?
27          2. How effectively is Florida's K-20 education system
28    educating its students?
29          3. How effectively are the major delivery sectors
30    promoting student achievement?
31          4. How are individual schools and postsecondary education
32    institutions performing their responsibility to educate their
33    students as measured by how students are performing and how much
34    they are learning?
35          (b) The K-20 education performance accountability system
36    be established as a single, unified accountability system with
37    multiple components, including, but not limited to, measures of
38    adequate yearly progress, individual student learning gains in
39    public schools, school grades, and return on investment.
40          (c) The K-20 education performance accountability system
41    comply with the accountability requirements of the “No Child
42    Left Behind Act of 2001,” PL 107-110.
43          (d)(b)The State Board of Education recommend to the
44    Legislature systemwide performance standards; the Legislature
45    establish systemwide performance measures and standards; and the
46    systemwide measures and standards provide Floridians with
47    information on what the public is receiving in return for the
48    funds it invests in education and how well the K-20 system
49    educates its students.
50          (e)(c)The State Board of Education establish performance
51    measures and set performance standards for individual components
52    of the public education system, including individual schools and
53    postsecondary educational institutions, with measures and
54    standards based primarily on student achievement.
55          (2) PERFORMANCE-BASED FUNDING.--
56          (a) The State Board of Education shall cooperate with the
57    Commissioner of Education andeach delivery system to develop
58    proposals for performance-based funding, using performance
59    measures adopted pursuant to this sectionestablished by the
60    Legislature.
61          (b) The State Board of Educationproposals must provide
62    that at least 10 percent of the state funds appropriated for the
63    K-20 education system are conditional upon meeting or exceeding
64    established performance standards. The State Board of Education
65    must submit the recommendations to the Legislature in the
66    following sequence:
67          (a) By December 1, 2002, recommendations for state
68    universities, for consideration by the 2003 Legislature and
69    implementation in the 2003-2004 fiscal year.
70          (b) By December 1, 2003, recommendations for public
71    schools and workforce education, for consideration by the 2004
72    Legislature and implementation in the 2004-2005 fiscal year.
73          (c) By December 1, 2004, recommendations for community
74    colleges, for consideration by the 2005 Legislature and
75    implementation in the 2005-2006 fiscal year.
76          (d) By December 1, 2005, recommendations for all other
77    programs that receive state funds within the Department of
78    Education.
79          (c) The State Board of Education shall adopt guidelines
80    required to implement performance-based funding that allow 1
81    year to demonstrate achievement of specified performance
82    standards prior to a reduction in appropriations pursuant to
83    this section.
84          (d) By December 1, 2003, the State Board of Education
85    shall adopt common definitions, measures, standards, and
86    performance improvement targets required to:
87          1. Use the state core measures and the sector-specific
88    measures to evaluate the progress of each sector of the
89    educational delivery system toward meeting the systemwide goals
90    for public education.
91          2. Notify the sectors of their progress in achieving the
92    specified measures so that they may develop improvement plans
93    that directly influence decisions about policy, program
94    development, and management.
95          3. Implement the performance-based budgeting system
96    described in this section.
97          (e) During the 2003-2004 fiscal year, the Department of
98    Education shall collect data required to establish progress,
99    rewards, and sanctions.
100          (f) By December 1, 2004, the Department of Education shall
101    recommend to the Legislature a formula for performance-based
102    funding that applies accountability standards for the individual
103    components of the public education system at every level,
104    kindergarten through graduate school. Effective for the 2004-
105    2005 fiscal year and thereafter, subject to annual legislative
106    approval in the General Appropriations Act, performance-based
107    funds shall be allocated based on the progress, rewards, and
108    sanctions established pursuant to this section.
109          (3) MISSION, GOALS, AND SYSTEMWIDE MEASURES.--
110          (a)The mission of Florida's K-20 education system shall
111    be to increase the proficiency of all students within one
112    seamless, efficient system, by allowing them the opportunity to
113    expand their knowledge and skills through learning opportunities
114    and research valued by students, parents, and communities.
115          (b The State Board of Education shall adopt guiding
116    principles for establishing state and sector-specific standards
117    and measures.
118          (c) The State Board of Education shall, and tomaintain an
119    accountability system that measures student progress toward the
120    following goals:
121          1.(a)Highest student achievement, as measured by: student
122    FCAT performance and annual learning gains; the number and
123    percentage of schools that improve at least one school
124    performance grade designation or maintain a school performance
125    grade designation of "A" pursuant to s. 1008.34; graduation or
126    completion rates at all learning levels; and other measures
127    identified in law or rule.
128          2.(b)Seamless articulation and maximum access, as
129    measured by: the percentage of students who demonstrate
130    readiness for the educational level they are entering, from
131    kindergarten through postsecondary education and into the
132    workforce; the number and percentage of students needing
133    remediation; the percentage of Floridians who complete
134    associate, baccalaureate, graduate,professional, and
135    postgraduate degrees; the number and percentage of credits that
136    articulate; the extent to which each set of exit-point
137    requirements matches the next set of entrance-point
138    requirements; the degree to which underserved populations access
139    educational opportunity; the extent to which access is provided
140    through innovative educational delivery strategies;and other
141    measures identified in law or rule.
142          3.(c)Skilled workforce and economic development, as
143    measured by: the number and percentage of graduates employed in
144    their areas of preparation; the percentage of Floridians with
145    high school diplomas and postsecondary education credentials;
146    the percentage of business and community members who find that
147    Florida's graduates possess the skills they need; national
148    rankings;and other measures identified in law or rule.
149          4.(d)Quality efficient services, as measured by: cost per
150    completer or graduate; average cost per noncompleter at each
151    educational level; cost disparity across institutions offering
152    the same degrees; the percentage of education customers at each
153    educational level who are satisfied with the education provided;
154    and other measures identified in law or rule.
155          (4) SYSTEMWIDE DATA COLLECTION.--School districts and
156    public postsecondary educational institutions shall maintain
157    information systems that will provide the State Board of
158    Education and the Legislature with information and reports
159    necessary to address the specifications of the accountability
160    system. The State Board of Education shall determine the
161    standards for the required data. Theat alevel of
162    comprehensiveness and quality shall beno less than that which
163    was available as of June 30, 2001.
164          Section 2. The State Board of Education shall conduct a
165    concordance study to determine if crosswalk scores can be
166    determined to be equivalent to those required on the Florida
167    Comprehensive Assessment Test (FCAT) for high school graduation.
168    At a minimum, the state board shall analyze the PSAT, PLAN, SAT,
169    ACT, and the College Placement Test to determine if equivalent
170    scores can be determined. In cases where such equivalencies can
171    be determined, the state board is authorized to adopt those
172    scores as meeting the graduation requirement in lieu of the FCAT
173    passing score. Each time the score is changed, new equivalencies
174    must be determined. This provision shall take effect for
175    students who are eligible to graduate in the 2003-2004 academic
176    year and thereafter.
177          Section 3. This act shall take effect upon becoming a law.
