2 An act relating to trust funds; terminating and
3 re-creating the Workers' Compensation
4 Administration Trust Fund within the Department
5 of Business and Professional Regulation without
6 modification; carrying forward current balances
7 and continuing current sources and uses
8 thereof; repealing s. 440.501(3), F.S.,
9 relating to termination and review of the trust
10 fund, to conform; providing an effective date.

12 WHEREAS, the Legislature wishes to extend the life of
13 the Workers' Compensation Administration Trust Fund within the
14 Department of Business and Professional Regulation, which is
15 otherwise scheduled to be terminated pursuant to
16 constitutional mandate, and
17 WHEREAS, the Legislature has reviewed the trust fund
18 before its scheduled termination date and has found that it
19 continues to meet an important public purpose, and
20 WHEREAS, the Legislature has found that existing public
21 policy concerning the trust fund sets adequate parameters for
22 its use, NOW, THEREFORE,

24 Be It Enacted by the Legislature of the State of Florida:
25
26 Section 1. (1) The Workers' Compensation
27 Administration Trust Fund within the Department of Business
28 and Professional Regulation, FLAIR number 79-2-795, which is
29 to be terminated pursuant to Section 19(f), Article III of the
30 State Constitution on July 1, 2006, unless terminated sooner
31 by law, is terminated on November 4, 2004, and re-created.

1 (2) All current balances of the trust fund are carried
2 forward, and all current sources and uses of the trust fund
3 are continued.
4 Section 2. Subsection (3) of section 440.501, Florida
5 Statutes, is repealed.
6 Section 3. This act shall take effect November 4,
7 2004.
