1 A bill to be entitled
2 An act relating to trust funds; terminating and
3 re-creating the Emergency Response Trust Fund
4 within the Department of Military Affairs
5 without modification; carrying forward current
6 balances and continuing current sources and
7 uses thereof; repealing s. 250.601(4), F.S.,
8 which terminates the trust fund on July 1,
9 2006; providing an effective date.

11 WHEREAS, the Legislature wishes to extend the life of
12 the Emergency Response Trust Fund within the Department of
13 Military Affairs, which is otherwise scheduled to be
14 terminated pursuant to constitutional mandate, and
15 WHEREAS, the Legislature has reviewed the trust fund
16 before its scheduled termination date and has found that it
17 continues to meet an important public purpose, and
18 WHEREAS, the Legislature has found that existing public
19 policy concerning the trust fund sets adequate parameters for
20 its use, NOW, THEREFORE,

22 Be It Enacted by the Legislature of the State of Florida:

24 Section 1. (1) The Emergency Response Trust Fund
25 within the Department of Military Affairs, FLAIR number
26 62-2-087, which is to be terminated pursuant to Section 19(f),
27 Article III of the State Constitution and section 250.601(4),
28 Florida Statutes, on July 1, 2006, unless terminated sooner by
29 law, is terminated on November 4, 2004, and re-created.

1 (2) All current balances of the trust fund are carried
2 forward, and all current sources and uses of the trust fund
3 are continued.
4 Section 2. Subsection (4) of section 250.601, Florida
5 Statutes, as created by subsection (4) of section 1 of chapter
6 2002-167, Laws of Florida, is repealed.
7 Section 3. This act shall take effect November 4,
8 2004.

10 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
11 Senate Bill 930

13 This legislation re-creates the Emergency Response Trust Fund,
FLAIR number 62-2-087, which is administered by the Department
14 of Military Affairs. Re-creation is effective for four years
beginning on November 4, 2004, the current termination date of
15 the fund.
