1 A bill to be entitled
2 An act relating to trust funds; terminating a
3 specified trust fund within the Department of
4 Transportation; providing for disposition of
5 balances in and revenues of that trust fund;
6 declaring the findings of the Legislature that
7 specified trust funds within the Executive
8 Office of the Governor, the Department of
9 Transportation, and the Department of Highway
10 Safety and Motor Vehicles are exempt from the
11 termination requirements of s. 19(f), Art. III
12 of the State Constitution; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. (1) Within the Department of
18 Transportation, the Turnpike Controlled Access Trust Fund,
19 FLAIR number 55-2-334, is terminated.
20 (2) Unless otherwise provided, all current balances
21 remaining in, and all revenues of, each trust fund terminated
22 by this act shall be transferred to the General Revenue Fund.
23 (3) For each trust fund terminated by this act, the
24 agency that administers the trust fund shall pay any
25 outstanding debts and obligations of the terminated fund as
26 soon as practicable, and the Chief Financial Officer shall
27 close out and remove the terminated fund from the various
28 state accounting systems using generally accepted accounting
29 principles concerning warrants outstanding, assets, and
30 liabilities.

1 Section 2. The Legislature finds that the following
2 trust funds are exempt from termination pursuant to Section
3 19(f), Article III of the State Constitution:
4 (1) Within the Executive Office of the Governor:
5 (a) The Black Contractors Bond Trust Fund, FLAIR
6 number 31-2-056.
7 (b) The Florida Investment Incentive Trust Fund, FLAIR
8 number 31-2-293.
9 (c) The Administered Funds Trust Fund, FLAIR number
10 31-2-732. This trust fund, created by section 216.273, Florida
11 Statutes, was previously known as the Trust Funds Trust Fund.
12 (2) Within the Department of Transportation:
13 (a) The Central Florida Beltway Trust Fund, FLAIR
14 number 55-2-074.
15 (b) The Everglades Parkway Construction Trust Fund,
16 FLAIR number 55-2-199.
17 (c) The Turnpike Renewals and Replacement Trust Fund,
18 FLAIR number 55-2-324.
19 (d) The Turnpike General Reserve Trust Fund, FLAIR
20 number 55-2-326.
21 (e) The Turnpike Bond Construction Trust Fund, FLAIR
22 number 55-2-340.
23 (f) The Jacksonville Transportation Authority Project
24 Construction Trust Fund, FLAIR number 55-2-413.
25 (g) The Jefferson County 1992 Project Construction
26 Trust Fund, FLAIR number 55-2-418.

16 SENATE SUMMARY
17 Terminates a trust fund within the Department of
Transportation. Provides for disposition of the balance
18 in that trust fund. Specifies the trust funds within the
Executive Office of the Governor, the Department of
19 Transportation, and the Department of Highway Safety and
Motor Vehicles which are exempt from termination under s.
