1 A bill to be entitled
2          An act relating to the Florida Retirement System; amending
3    s. 121.0515, F.S.; providing eligibility of certain
4    treatment and rehabilitation personnel at correctional or
5    forensic facilities for membership in the Special Risk
6    Class; providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Subsection (2) of section 121.0515, Florida
11    Statutes, is amended to read:
12          121.0515 Special risk membership.--
13          (2) CRITERIA.--A member, to be designated as a special
14    risk member, must meet the following criteria:
15          (a) The member must be employed as a law enforcement
16    officer and be certified, or required to be certified, in
17    compliance with s. 943.1395; however, sheriffs and elected
18    police chiefs shall be excluded from meeting the certification
19    requirements of this paragraph. In addition, the member's duties
20    and responsibilities must include the pursuit, apprehension, and
21    arrest of law violators or suspected law violators; or the
22    member must be an active member of a bomb disposal unit whose
23    primary responsibility is the location, handling, and disposal
24    of explosive devices; or the member must be the supervisor or
25    command officer of a member or members who have such
26    responsibilities; provided, however, administrative support
27    personnel, including, but not limited to, those whose primary
28    duties and responsibilities are in accounting, purchasing,
29    legal, and personnel, shall not be included;
30          (b) The member must be employed as a firefighter and be
31    certified, or required to be certified, in compliance with s.
32    633.35 and be employed solely within the fire department of a
33    local government employer or an agency of state government with
34    firefighting responsibilities. In addition, the member's duties
35    and responsibilities must include on-the-scene fighting of
36    fires, fire prevention, or firefighter training; direct
37    supervision of firefighting units, fire prevention, or
38    firefighter training; or aerial firefighting surveillance
39    performed by fixed-wing aircraft pilots employed by the Division
40    of Forestry of the Department of Agriculture and Consumer
41    Services; or the member must be the supervisor or command
42    officer of a member or members who have such responsibilities;
43    provided, however, administrative support personnel, including,
44    but not limited to, those whose primary duties and
45    responsibilities are in accounting, purchasing, legal, and
46    personnel, shall not be included and further provided that all
47    periods of creditable service in fire prevention or firefighter
48    training, or as the supervisor or command officer of a member or
49    members who have such responsibilities, and for which the
50    employer paid the special risk contribution rate, shall be
51    included;
52          (c) The member must be employed as a correctional officer
53    and be certified, or required to be certified, in compliance
54    with s. 943.1395. In addition, the member's primary duties and
55    responsibilities must be the custody, and physical restraint
56    when necessary, of prisoners or inmates within a prison, jail,
57    or other criminal detention facility, or while on work detail
58    outside the facility, or while being transported; or the member
59    must be the supervisor or command officer of a member or members
60    who have such responsibilities; provided, however,
61    administrative support personnel, including, but not limited to,
62    those whose primary duties and responsibilities are in
63    accounting, purchasing, legal, and personnel, shall not be
64    included; however, wardens and assistant wardens, as defined by
65    rule, shall participate in the Special Risk Class;
66          (d) The member must be employed by a licensed Advance Life
67    Support (ALS) or Basic Life Support (BLS) employer as an
68    emergency medical technician or a paramedic and be certified in
69    compliance with s. 401.27. In addition, the member's primary
70    duties and responsibilities must include on-the-scene emergency
71    medical care or direct supervision of emergency medical
72    technicians or paramedics, or the member must be the supervisor
73    or command officer of one or more members who have such
74    responsibility. However, administrative support personnel,
75    including, but not limited to, those whose primary
76    responsibilities are in accounting, purchasing, legal, and
77    personnel, shall not be included;
78          (e) The member must be employed as a community-based
79    correctional probation officer and be certified, or required to
80    be certified, in compliance with s. 943.1395. In addition, the
81    member's primary duties and responsibilities must be the
82    supervised custody, surveillance, control, investigation, and
83    counseling of assigned inmates, probationers, parolees, or
84    community controllees within the community; or the member must
85    be the supervisor of a member or members who have such
86    responsibilities. Administrative support personnel, including,
87    but not limited to, those whose primary duties and
88    responsibilities are in accounting, purchasing, legal services,
89    and personnel management, shall not be included; however,
90    probation and parole circuit and deputy circuit administrators
91    shall participate in the Special Risk Class; or
92          (f) The member must be employed in one of the following
93    classes and must spend at least 75 percent of his or her time
94    performing duties which involve contact with patients or inmates
95    in a correctional or forensic facility or institution:
96          1. Dietitian (class codes 5203 and 5204).
97          2. Public health nutrition consultant (class code 5224).
98          3. Psychological specialist (class codes 5230 and 5231).
99          4. Psychologist (class code 5234).
100          5. Senior psychologist (class codes 5237 and 5238).
101          6. Regional mental health consultant (class code 5240).
102          7. Psychological Services Director--DCF (class code 5242).
103          8. Pharmacist (class codes 5245 and 5246).
104          9. Senior pharmacist (class codes 5248 and 5249).
105          10. Dentist (class code 5266).
106          11. Senior dentist (class code 5269).
107          12. Registered nurse (class codes 5290 and 5291).
108          13. Senior registered nurse (class codes 5292 and 5293).
109          14. Registered nurse specialist (class codes 5294 and
110    5295).

162            (g) The member must be employed by the Department of
163    Children and Family Services in one of the following classes and
164    must spend as least 75 percent of his or her time performing
165    duties which involve contact with patients or inmates in a
166    forensic facility or institution:
167          1. Unit treatment and rehabilitation senior supervisor I-
168    F/C (class code 5793).
169          2. Unit treatment and rehabilitation senior supervisor II-
170    F/C (class code 5796).
171          3. Unit treatment and rehabilitation supervisor I-F/C
172    (class code 5786).
173          4. Unit treatment and rehabilitation senior supervisor I
174    (class code 5777).
175          5. Unit treatment and rehabilitation senior supervisor II
176    (class code 5778).
177          6. Unit treatment and rehabilitation supervisor III (class
178    code 5780).
179          7. Unit treatment and rehabilitation senior supervisor III-
180    F/C (class code 5799).

184          (h)(g) The member must be employed as a youth custody
185    officer and be certified, or required to be certified, in
186    compliance with s. 943.1395. In addition, the member's primary
187    duties and responsibilities must be the supervised custody,
188    surveillance, control, investigation, apprehension, arrest, and
189    counseling of assigned juveniles within the community.
190          Section 2. This act shall take effect July 1, 2003.
