10 A bill to be entitled
11          An act relating to the Department of Agriculture and
12    Consumer Services; amending s. 570.15, F.S.; requiring the
13    department to establish rules authorizing nonagricultural
14    vehicles to pass an agricultural inspection station
15    without stopping and submitting to an inspection; amending
16    s. 570.16, F.S.; prohibiting a person from impersonating
17    an inspector, agent, or other employee of the department;
18    providing a penalty; providing an effective date.
19         
20          Be It Enacted by the Legislature of the State of Florida:
21         
22          Section 1. Subsection (2) of section 570.15, Florida
23    Statutes, is amended, and subsection (5) is added to that
24    section, to read:
25          570.15 Access to places of business and vehicles.--
26          (2) It is unlawful for the driver of any vehicle, other
27    than one exempted in sub-subparagraph (1)(a)1.g. or one
28    authorized pursuant to subsection (5), to pass any official
29    agricultural inspection station without first stopping and
30    submitting the vehicle for inspection. A violation of this
31    subsection constitutes a misdemeanor of the second degree,
32    punishable as provided in s. 775.082 or s. 775.083.
33          (5) The department shall establish by rule conditions and
34    criteria by which nonagricultural laden vehicles may pass an
35    agricultural inspection station without stopping for inspection.
36          Section 2. Section 570.16, Florida Statutes, is amended to
37    read:
38          570.16 Interference with department employees in
39    performance of duties.--No person shall attempt, by means of any
40    threat or violence, to deter or prevent an inspector, agent, or
41    other employee of the department from performing any duties
42    imposed by law upon him or her or the department and no person
43    shall impersonate an inspector, agent, or other employee of the
44    department. Whoever violates this section commits a misdemeanor
45    of the second degree, punishable as provided in s. 775.082 or s.
46    775.083.
47          Section 3. This act shall take effect upon becoming a law.
