1 A bill to be entitled
2          An act relating to the Department of Agriculture and
3    Consumer Services; amending s. 570.15, F.S.; requiring the
4    department to establish rules authorizing nonagricultural
5    vehicles to pass an agricultural inspection station
6    without stopping and submitting to an inspection; amending
7    s. 570.16, F.S.; prohibiting a person from impersonating
8    an inspector, agent, or other employee of the department;
9    providing a penalty; providing an effective date.

11          Be It Enacted by the Legislature of the State of Florida:
12         
13          Section 1. Subsection (2) of section 570.15, Florida
14    Statutes, is amended, and subsection (5) is added to that
15    section, to read:
16          570.15 Access to places of business and vehicles.--
17          (2) It is unlawful for the driver of any vehicle, other
18    than one exempted in sub-subparagraph (1)(a)1.g. or one
19    authorized pursuant to subsection (5), to pass any official
20    agricultural inspection station without first stopping and
21    submitting the vehicle for inspection. A violation of this
22    subsection constitutes a misdemeanor of the second degree,
23    punishable as provided in s. 775.082 or s. 775.083.
24          (5) The department shall establish by rule conditions and
25    criteria by which nonagricultural laden vehicles may pass an
26    agricultural inspection station without stopping for inspection.
27          Section 2. Section 570.16, Florida Statutes, is amended to
28    read:
29          570.16 Interference with department employees in
30    performance of duties.--No person shall attempt, by means of any
31    threat or violence, to deter or prevent an inspector, agent, or
32    other employee of the department from performing any duties
33    imposed by law upon him or her or the department and no person
34    shall impersonate an inspector, agent, or other employee of the
35    department. Whoever violates this section commits a misdemeanor
36    of the second degree, punishable as provided in s. 775.082 or s.
37    775.083.
38          Section 3. This act shall take effect July 1, 2003.
