An act relating to the Governor's Council on Physical |

Fitness and Health; providing for powers and duties, |

membership and terms thereof; providing for reimbursement |

for per diem and travel expenses for members of the |

council; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. There is hereby created the Governor's Council |
11
|
on Physical Fitness and Health within the Office of the |
12
|
Governor. (1) POWERS AND DUTIES.--The council shall have the |
13
|
following powers and duties:
|

|
(a) To promote interest in the area of physical fitness; |
15
|
to consider the need for new programs in the field of physical |
16
|
fitness; to enlist the active support of individual citizens, |
17
|
professional and civic groups, amateur and professional |
18
|
athletes, voluntary organizations, state and local government |
19
|
agencies, private industry and business, and community |
20
|
recreation programs in efforts to improve the physical fitness |
21
|
and the health of the citizens of this state.

|
(b) To examine current physical fitness programs available |
23
|
to the people of this state and to make recommendations to the |
24
|
Governor for coordination of programs to prevent duplication of |
25
|
such services; to support physical fitness programs in the |
26
|
public school system; to develop cooperative programs with |
27
|
medical, dental, and other groups; to maintain a liaison with |
28
|
government, private, and other agencies concerning physical |
29
|
fitness programs; to stimulate research in the area of physical |
30
|
fitness; to sponsor physical fitness workshops, clinics, |
31
|
conferences, and other related activities pertaining to physical |
32
|
fitness throughout the state.

(c) To recognize outstanding developments, contributions, |
34
|
and achievements in physical fitness in this state and to serve |
35
|
as the sanctioning body for competitive athletic events for |
36
|
which sanctioning by the state is required.
|

|
(d) To make an annual report to the Governor that shall |
38
|
include suggestions and recommendations for the furtherance of |
39
|
the physical fitness of the people of this state.
|

|
(2) MEMBERSHIP; TERMS; QUORUM; PER DIEM;.--
|

|
(a) The council shall consist of 10 members, including a |
42
|
chair. The composition of the council shall be as follows:
|

|
1. One member of the Senate appointed by the President of |
44
|
the Senate, one member of the House of Representatives appointed |
45
|
by the Speaker of the House of Representatives, and eight |
46
|
persons from the health care professions, the fields of business |
47
|
and industry, physical education, recreation, sports, and the |
48
|
general public. The eight nonlegislative members of the council |
49
|
shall be appointed by the Governor and serve at the pleasure of |
50
|
the Governor.
|

2. The eight initial nonlegislative members of the council |
52
|
shall be appointed as follows: two for a term of 1 year, two for |
53
|
a term of 2 years, two for a term of 3 years, and two for a term |
54
|
of 4 years. At the end of the respective terms of office of |
55
|
these initial members, all succeeding appointments of |
56
|
nonlegislative members shall be for terms of 4 years. |

|
Nonlegislative members shall serve no more than two consecutive |
58
|
4-year terms. All unexpired terms due to resignation, death, |
59
|
disability, removal, or refusal to serve shall be filled by a |
60
|
person appointed by the Governor for the balance of the |
61
|
unexpired term.

3. Legislative members of the council shall serve 2-year |
63
|
terms beginning and ending on July 1 of odd-numbered years, and |
64
|
shall serve no more than two consecutive terms.
|

|
(b) The council shall meet no more than quarterly and a |
66
|
majority of the council shall constitute a quorum for the |
67
|
transaction of business.
|

|
(c) Members of the council shall receive no compensation |
69
|
but shall receive reimbursement for per diem and travel expenses |
70
|
as provided in s. 112.061, Florida Statutes, while in the |
71
|
performance of their duties.

Section 2. This act shall take effect upon becoming a law. |
