11          An act relating to physical fitness and health; amending
12    s. 288.1229, F.S.; creating the Governor’s Advisory
13    Council for a Fit Florida; providing for powers and
14    duties, membership, and terms thereof; providing for
15    reimbursement for per diem and travel expenses for members
16    of the council; providing for a Fit Florida Alliance;
17    providing for future repeal; providing an effective date.

19          Be It Enacted by the Legislature of the State of Florida:
20         
21          Section 1. Subsection (10) is added to section 288.1229,
22    Florida Statutes, to read:
23          288.1229 Promotion and development of sports-related
24    industries and amateur athletics; direct-support organization;
25    powers and duties.--
26          (10)(a) There is created the Governor’s Advisory Council
27    for a Fit Florida within the direct-support organization for the
28    purpose of serving as an advisory body to the direct-support
29    organization to provide insight and expertise relating to
30    physical fitness and nutrition in the state. In order to
31    accomplish this purpose, the council shall:
32          1. Advise the direct-support organization on ways to
33    promote interest in the area of physical fitness and nutrition
34    and provide assistance in such promotion.
35          2. Examine current physical fitness and nutrition programs
36    available to the people of the state and recommend to the
37    direct-support organization any coordination of programs needed
38    to prevent duplication of services.
39          3. Recommend ways in which the direct-support organization
40    could promote and support physical fitness programs in the
41    public school system, including consideration of appropriate
42    levels of physical activity and standards of proper nutrition.
43          4. Advise the direct-support organization on the need for
44    new programs in the field of physical fitness and nutrition.
45          5. Assist the direct-support organization in enlisting the
46    active support of a Fit Florida Alliance comprised of individual
47    citizens, professional and civic groups, amateur and
48    professional athletes, voluntary organizations, state and local
49    government agencies, private industry and business, and
50    community recreation programs in efforts to improve the physical
51    fitness and health of the citizens of this state.
52          6. Make recommendations to the direct-support organization
53    on appointments to a Fit Florida Alliance.
54          7. Make recommendations to the direct-support organization
55    with regard to recognition programs for schools and communities
56    participating in physical fitness and nutrition efforts;
57    sponsorship of physical fitness workshops, clinics, conferences,
58    and other related activities; liaison efforts with government,
59    private, and other agencies concerning physical fitness and
60    nutrition programs; the need for dissemination of information
61    regarding physical fitness and nutrition programs, including the
62    type of information, the target audience, and the method of
63    dissemination; and the participation of government, individuals,
64    organizations, and business entities in program development,
65    support, and funding of initiatives relating to physical fitness
66    and nutrition efforts recommended by the council and initiated
67    by the direct-support organization.
68          8. Provide an annual report to the Governor, the Office of
69    Tourism, Trade, and Economic Development, and the direct-support
70    organization that shall include recommendations for the
71    furtherance of the physical fitness of the people of this state.
72          (b)1. The council shall consist of ten members to be
73    appointed as follows: eight shall be appointed by the Governor,
74    one shall be appointed by the President of the Senate, and one
75    shall be appointed by the Speaker of the House of
76    Representatives, with the initial appointments being made no
77    later than September 1, 2003.
78          2. When making appointments to the council, the Governor,
79    the President of the Senate, and the Speaker of the House of
80    Representatives shall appoint persons from the health care
81    professions and the fields of business and industry, physical
82    education, recreation, and sports, and the general public.
83          3. Members of the council appointed by the President of
84    the Senate and the Speaker of the House of Representatives shall
85    be appointed for a term of 2 years, beginning and ending on July
86    1 of odd-numbered years. Members of the council appointed by the
87    President of the Senate and the Speaker of the House of
88    Representatives shall serve no more than two consecutive terms
89    and shall serve at the pleasure of the official who appointed
90    the member of the council.
91          4. The eight initial members of the council appointed by
92    the Governor shall be appointed as follows: two for a term of 1
93    year, two for a term of 2 years, two for a term of 3 years, and
94    two for a term of 4 years. At the end of the respective terms of
95    office of the initial members, all succeeding appointments shall
96    be for terms of 4 years. Members of the council appointed by the
97    Governor shall serve no more than two consecutive 4-year terms
98    and shall serve at the pleasure of the Governor.
99          5. All unexpired terms due to vacancy shall be filled by
100    the official who appointed the council member.
101          6. The council shall annually elect from the membership
102    one member to serve as chair of the council and one member to
103    serve as vice chair.
104          7. The council shall meet no more than quarterly and a
105    majority of the members of the council shall constitute a quorum
106    for the transaction of business.
107          8. Members of the council shall serve without compensation
108    but shall be entitled to reimbursement for per diem and travel
109    expenses as provided in s. 112.061 while in the performance of
110    their duties.
111          (c) This subsection is repealed on July 1, 2008.
112          Section 2. This act shall take effect upon becoming a law.
