Be It Enacted by the Legislature of the State of Florida: |
21
|
|

|
Section 1. Subsection (10) is added to section 288.1229, |
23
|
Florida Statutes, to read: |
24
|
288.1229 Promotion and development of sports-related |
25
|
industries and amateur athletics; direct-support organization; |
26
|
powers and duties.-- |

|
(10)(a) There is created the Governor’s Advisory Council |
28
|
for a Fit Florida within the direct-support organization for the |
29
|
purpose of serving as an advisory body to the direct-support |
30
|
organization to provide insight and expertise relating to |
31
|
physical fitness and nutrition in the state. In order to |
32
|
accomplish this purpose, the council shall:
|
33
|
1. Advise the direct-support organization on ways to |
34
|
promote interest in the area of physical fitness and nutrition |
35
|
and provide assistance in such promotion.
|
36
|
2. Examine current physical fitness and nutrition programs |
37
|
available to the people of the state and recommend to the |
38
|
direct-support organization any coordination of programs needed |
39
|
to prevent duplication of services.
|
40
|
3. Recommend ways in which the direct-support organization |
41
|
could promote and support physical fitness programs in the |
42
|
public school system, including consideration of appropriate |
43
|
levels of physical activity and standards of proper nutrition.
|
44
|
4. Advise the direct-support organization on the need for |
45
|
new programs in the field of physical fitness and nutrition.
|
46
|
5. Assist the direct-support organization in enlisting the |
47
|
active support of a Fit Florida Alliance comprised of individual |
48
|
citizens, professional and civic groups, amateur and |
49
|
professional athletes, voluntary organizations, state and local |
50
|
government agencies, private industry and business, and |
51
|
community recreation programs in efforts to improve the physical |
52
|
fitness and health of the citizens of this state.
|

|
6. Make recommendations to the direct-support organization |
54
|
on appointments to a Fit Florida Alliance.
|
55
|
7. Make recommendations to the direct-support organization |
56
|
with regard to recognition programs for schools and communities |
57
|
participating in physical fitness and nutrition efforts; |
58
|
sponsorship of physical fitness workshops, clinics, conferences, |
59
|
and other related activities; liaison efforts with government, |
60
|
private, and other agencies concerning physical fitness and |
61
|
nutrition programs; the need for dissemination of information |
62
|
regarding physical fitness and nutrition programs, including the |
63
|
type of information, the target audience, and the method of |
64
|
dissemination; and the participation of government, individuals, |
65
|
organizations, and business entities in program development, |
66
|
support, and funding of initiatives relating to physical fitness |
67
|
and nutrition efforts recommended by the council and initiated |
68
|
by the direct-support organization.
|

8. Make recommendations to the direct-support organization |
70
|
for the use of funds received specifically for the purpose of |
71
|
promoting physical fitness and nutrition. |

|
9. Provide an annual report to the Governor, the President |
73
|
of the Senate, the Speaker of the House of Representatives, the |
74
|
Office of Tourism, Trade, and Economic Development, and the |
75
|
direct-support organization that shall include recommendations |
76
|
for the furtherance of the physical fitness of the people of |
77
|
this state. |

(b)1. The council shall consist of ten members to be |
79
|
appointed as follows: eight shall be appointed by the Governor, |
80
|
one shall be appointed by the President of the Senate, and one |
81
|
shall be appointed by the Speaker of the House of |
82
|
Representatives, with the initial appointments being made no |
83
|
later than September 1, 2003. |

2. When making appointments to the council, the Governor, |
85
|
the President of the Senate, and the Speaker of the House of |
86
|
Representatives shall appoint persons from health care |
87
|
professions, health insurance companies, the fields of business, |
88
|
industry, physical education, recreation, and sports, and the |
89
|
general public.
|

|
3. Members of the council appointed by the President of |
91
|
the Senate and the Speaker of the House of Representatives shall |
92
|
be appointed for a term of 2 years, beginning and ending on July |
93
|
1 of odd-numbered years. Members of the council appointed by the |
94
|
President of the Senate and the Speaker of the House of |
95
|
Representatives shall serve no more than two consecutive terms |
96
|
and shall serve at the pleasure of the official who appointed |
97
|
the member of the council.
|

|
4. The eight initial members of the council appointed by |
99
|
the Governor shall be appointed as follows: two for a term of 1 |
100
|
year, two for a term of 2 years, two for a term of 3 years, and |
101
|
two for a term of 4 years. At the end of the respective terms of |
102
|
office of the initial members, all succeeding appointments shall |
103
|
be for terms of 4 years. Members of the council appointed by the |
104
|
Governor shall serve no more than two consecutive 4-year terms |
105
|
and shall serve at the pleasure of the Governor.
|

|
5. All unexpired terms due to vacancy shall be filled by |
107
|
the official who appointed the council member.
|

|
6. The council shall annually elect from the membership |
109
|
one member to serve as chair of the council and one member to |
110
|
serve as vice chair.
|

|
7. The council shall meet no more than quarterly and a |
112
|
majority of the members of the council shall constitute a quorum |
113
|
for the transaction of business.
|

|
8. Members of the council shall serve without compensation |
115
|
but shall be entitled to reimbursement for per diem and travel |
116
|
expenses as provided in s. 112.061 while in the performance of |
117
|
their duties.
|

|
(c) This subsection is repealed on July 1, 2008. |

|
Section 2. This act shall take effect upon becoming a law. |
