1 A bill to be entitled
2          An act relating to physical fitness and health; amending
3    s. 288.1229, F.S.; creating the Governor’s Advisory
4    Council for a Fit Florida; providing for powers and
5    duties, membership, and terms thereof; providing for
6    reimbursement for per diem and travel expenses for members
7    of the council; providing for a Fit Florida Alliance;
8    requiring an annual report; providing for future repeal;
9    providing an effective date.

11          Be It Enacted by the Legislature of the State of Florida:
12         
13          Section 1. Subsection (10) is added to section 288.1229,
14    Florida Statutes, to read:
15          288.1229 Promotion and development of sports-related
16    industries and amateur athletics; direct-support organization;
17    powers and duties.--
18          (10)(a) There is created the Governor’s Advisory Council
19    for a Fit Florida within the direct-support organization for the
20    purpose of serving as an advisory body to the direct-support
21    organization to provide insight and expertise relating to
22    physical fitness and nutrition in the state. In order to
23    accomplish this purpose, the council shall:
24          1. Advise the direct-support organization on ways to
25    promote interest in the area of physical fitness and nutrition
26    and provide assistance in such promotion.
27          2. Examine current physical fitness and nutrition programs
28    available to the people of the state and recommend to the
29    direct-support organization any coordination of programs needed
30    to prevent duplication of services.
31          3. Recommend ways in which the direct-support organization
32    could promote and support physical fitness programs in the
33    public school system, including consideration of appropriate
34    levels of physical activity and standards of proper nutrition.
35          4. Advise the direct-support organization on the need for
36    new programs in the field of physical fitness and nutrition.
37          5. Assist the direct-support organization in enlisting the
38    active support of a Fit Florida Alliance comprised of individual
39    citizens, professional and civic groups, amateur and
40    professional athletes, voluntary organizations, state and local
41    government agencies, private industry and business, and
42    community recreation programs in efforts to improve the physical
43    fitness and health of the citizens of this state.
44          6. Make recommendations to the direct-support organization
45    on appointments to a Fit Florida Alliance.
46          7. Make recommendations to the direct-support organization
47    with regard to recognition programs for schools and communities
48    participating in physical fitness and nutrition efforts;
49    sponsorship of physical fitness workshops, clinics, conferences,
50    and other related activities; liaison efforts with government,
51    private, and other agencies concerning physical fitness and
52    nutrition programs; the need for dissemination of information
53    regarding physical fitness and nutrition programs, including the
54    type of information, the target audience, and the method of
55    dissemination; and the participation of government, individuals,
56    organizations, and business entities in program development,
57    support, and funding of initiatives relating to physical fitness
58    and nutrition efforts recommended by the council and initiated
59    by the direct-support organization.
60          8. Make recommendations to the direct-support organization
61    for the use of funds received specifically for the purpose of
62    promoting physical fitness and nutrition.
63          9. Provide an annual report to the Governor, the President
64    of the Senate, the Speaker of the House of Representatives, the
65    Office of Tourism, Trade, and Economic Development, and the
66    direct-support organization that shall include recommendations
67    for the furtherance of the physical fitness of the people of
68    this state.
69          (b)1. The council shall consist of ten members to be
70    appointed as follows: eight shall be appointed by the Governor,
71    one shall be appointed by the President of the Senate, and one
72    shall be appointed by the Speaker of the House of
73    Representatives, with the initial appointments being made no
74    later than September 1, 2003.
75          2. When making appointments to the council, the Governor,
76    the President of the Senate, and the Speaker of the House of
77    Representatives shall appoint persons from health care
78    professions, health insurance companies, the fields of business,
79    industry, physical education, recreation, and sports, and the
80    general public.
81          3. Members of the council appointed by the President of
82    the Senate and the Speaker of the House of Representatives shall
83    be appointed for a term of 2 years, beginning and ending on July
84    1 of odd-numbered years. Members of the council appointed by the
85    President of the Senate and the Speaker of the House of
86    Representatives shall serve no more than two consecutive terms
87    and shall serve at the pleasure of the official who appointed
88    the member of the council.
89          4. The eight initial members of the council appointed by
90    the Governor shall be appointed as follows: two for a term of 1
91    year, two for a term of 2 years, two for a term of 3 years, and
92    two for a term of 4 years. At the end of the respective terms of
93    office of the initial members, all succeeding appointments shall
94    be for terms of 4 years. Members of the council appointed by the
95    Governor shall serve no more than two consecutive 4-year terms
96    and shall serve at the pleasure of the Governor.
97          5. All unexpired terms due to vacancy shall be filled by
98    the official who appointed the council member.
99          6. The council shall annually elect from the membership
100    one member to serve as chair of the council and one member to
101    serve as vice chair.
102          7. The council shall meet no more than quarterly and a
103    majority of the members of the council shall constitute a quorum
104    for the transaction of business.
105          8. Members of the council shall serve without compensation
106    but shall be entitled to reimbursement for per diem and travel
107    expenses as provided in s. 112.061 while in the performance of
108    their duties.
109          (c) This subsection is repealed on July 1, 2008.
110          Section 2. This act shall take effect upon becoming a law.
