| 1 | A bill to be entitled | ||
| 2 | An act relating to charter county ad valorem tax | ||
| 3 | revenues; amending s. 200.071, F.S.; specifying that | ||
| 4 | certain charter counties are not prohibited from | ||
| 5 | limiting, by referendum, the amount of revenue raised | ||
| 6 | from ad valorem taxes under certain circumstances; | ||
| 7 | excluding certain ad valorem tax revenues; providing | ||
| 8 | limitations; requiring such counties to adopt a | ||
| 9 | resolution identifying certain programs and associated | ||
| 10 | required revenues for certain purposes; providing for | ||
| 11 | construction of the act in pari materia with laws enacted | ||
| 12 | during the 2003 Regular Session of the Legislature; | ||
| 13 | providing an effective date. | ||

| 15 | Be It Enacted by the Legislature of the State of Florida: | ||
| 16 | |||
| 17 | Section 1. Subsection (1) of section 200.071, Florida | ||
| 18 | Statutes, is amended to read: | ||
| 19 | 200.071 Limitation of millage; counties.-- | ||
| 20 | (1)(a)Except as otherwise provided herein, no ad valorem | ||
| 21 | tax millage shall be levied against real property and tangible | ||
| 22 | personal property by counties in excess of 10 mills, except for | ||
| 23 | voted levies. | ||
| 24 | (b) Charter counties exercising all powers of local self- | ||
| 25 | government are not prohibited from limiting, by referendum, the | ||
| 26 | amount of revenue that can be raised from ad valorem taxes, if | ||
| 27 | the electors are authorized to approve any levy not exceeding | ||
| 28 | the established limit and there is a means which provides | ||
| 29 | funding in the event of a disaster or emergency. However, | ||
| 30 | excluded from this provision are the ad valorem tax revenues | ||
| 31 | necessary to fund state-mandated unfunded requirements and fixed | ||
| 32 | capital outlay required by federal court order. In order to | ||
| 33 | exclude such additional mandates, any charter county which has | ||
| 34 | limited by referendum the amount of revenue that can be raised | ||
| 35 | by ad valorem taxes shall adopt a resolution identifying each | ||
| 36 | program and associated revenue required for funding. | ||
| 37 | Section 2. If any law amended by this act was also amended | ||
| 38 | by a law enacted at the 2003 Regular Session of the Legislature, | ||
| 39 | such laws shall be construed as if they had been enacted at the | ||
| 40 | same session of the Legislature, and full effect shall be given | ||
| 41 | to each if possible. | ||
| 42 | Section 3. This act shall take effect upon becoming a law. | ||
