1 A bill to be entitled
2          An act relating to driving privilege; providing a popular
3    name; creating s. 318.1225, F.S.; providing additional
4    charges for certain traffic violations; providing for
5    distribution of moneys collected; amending s. 318.21,
6    F.S.; revising provisions relating to disposition of civil
7    penalties by county courts; creating s. 322.287, F.S.;
8    providing additional fees for reinstatement of suspended
9    driving privilege; providing for distribution of moneys
10    collected; amending s. 318.1215, F.S.; clarifying that
11    funds be used for driver education programs in schools;
12    requiring that funds be used for enhancement of driver
13    education program funds; providing a requirement for
14    behind-the-wheel training; providing for construction of
15    the act; providing an effective date.

17          Be It Enacted by the Legislature of the State of Florida:
18         
19          Section 1. This act shall be known by the popular name the
20    "Dori Slosberg Road Safety Act."
21          Section 2. Section 318.1225, Florida Statutes, is created
22    to read:
23          318.1225 Additional charges for violation.--
24          (1) Notwithstanding s. 318.121 and in addition to the
25    stated fines in s. 318.18, the court shall impose an additional
26    $50 for all moving violations and an additional $20 for all
27    nonmoving violations.
28          (2) Notwithstanding s. 318.121 and in addition to any
29    other fines imposed, the court shall impose an additional $500
30    for any person who violates s. 316.027(1).
31          (3) Notwithstanding s. 318.121 and in addition to any
32    other fines imposed, the court shall impose a surcharge of $500
33    on any fine imposed pursuant to s. 316.192, s. 316.193, or s.
34    316.1935.
35          (4) All additional fines and surcharges collected pursuant
36    to this section and s. 322.287 shall be distributed by the
37    department as follows:
38          (a) One million dollars shall be distributed annually to
39    MADD Florida for public service announcements in the state.
40          (b) Five million dollars shall be distributed annually to
41    the Johnnie Bryars Byrd, Sr., Trust Fund for Alzheimer’s
42    Research.
43          (c) Five million dollars shall be distributed annually to
44    the Biomedical Research Trust Fund in the Department of Health
45    established under s. 20.435.

47          A total of one million dollars shall be used by the department
48    to fund the creation and operation of the Florida At-Risk Driver
49    Council and the study of the effects of aging on driving ability
50    required by legislation passed during the 2003 Regular Session
51    of the Legislature. The remaining funds resulting from the
52    additional fines and surcharges shall be used to fund teachers'
53    salaries to meet constitutional school class size requirements.
54          Section 3. Subsection (13) is added to section 318.21,
55    Florida Statutes, to read:
56          318.21 Disposition of civil penalties by county
57    courts.--All civil penalties received by a county court pursuant
58    to the provisions of this chapter shall be distributed and paid
59    monthly as follows:
60          (13) The additional fines and surcharges provided for
61    under s. 318.1225 must be collected by the clerk of the court
62    and remitted to the department for distribution as provided in
63    that section.
64          Section 4. Section 322.287, Florida Statutes, is created
65    to read:
66          322.287 Reinstatement fees.--
67          (1) In addition to any other fines, fees, or charges
68    imposed, the department shall impose an additional $50 fee for
69    reinstating and returning a license suspended pursuant to s.
70    322.27.
71          (2) In addition to any other fines, fees, or charges
72    imposed, the department shall impose an additional $500 fee for
73    reinstating and returning a license suspended pursuant to s.
74    322.2615 or s. 322.2616.
75          (3) No driving privileges shall be reinstated until
76    complete payment of the applicable fees under this section.
77          (4) All moneys collected pursuant to this section shall be
78    distributed in the manner provided in s. 318.1225.
79          Section 5. Section 318.1215, Florida Statutes, is amended
80    to read:
81          318.1215 Dori Slosberg Driver Education Safety
82    Act.--Effective October 1, 2002, notwithstanding the provisions
83    of s. 318.121, a board of county commissioners may require, by
84    ordinance, that the clerk of the court collect an additional $3
85    with each civil traffic penalty, which shall be used to fund
86    drivertrafficeducation programs in public and nonpublic
87    schools. The ordinance shall provide for the board of county
88    commissioners to administer the funds, which shall be used for
89    enhancement, and not replacement, of driver education program
90    funds. The funds shall be used for direct educational expenses
91    and shall not be used for administration. Each driver education
92    program receiving funds pursuant to this section shall require
93    that a minimum of 30 percent of a student's time in the program
94    shall be behind-the-wheel training.This section may be cited as
95    the "Dori Slosberg Driver Education Safety Act."
96          Section 6. If any law amended by this act was also amended
97    by a law enacted at the 2003 Regular Session of the Legislature,
98    such laws shall be construed as if they had been enacted at the
99    same session of the Legislature, and full effect shall be given
100    to each if possible.
101          Section 7. This act shall take effect October 1, 2003.
