| 1 | A bill to be entitled | ||
| 2 | An act relating to Indian reservations; amending s. | ||
| 3 | 285.16, F.S.; specifying that the state's jurisdiction | ||
| 4 | over criminal offenses committed within Indian | ||
| 5 | reservations does not apply to Indian reservations of the | ||
| 6 | Miccosukee Tribe of Indians of Florida; providing an | ||
| 7 | exception for such reservations with respect to the | ||
| 8 | applicability of civil and criminal laws of the state; | ||
| 9 | providing for construction of the act in pari materia with | ||
| 10 | laws enacted during the 2003 Regular Session of the | ||
| 11 | Legislature; providing an effective date. | ||

| 13 | Be It Enacted by the Legislature of the State of Florida: | ||
| 14 | |||
| 15 | Section 1. Section 285.16, Florida Statutes, is amended to | ||
| 16 | read: | ||
| 17 | 285.16 Civil and criminal jurisdiction; Indian | ||
| 18 | reservation; exception.-- | ||
| 19 | (1) The State of Florida hereby assumes jurisdiction over | ||
| 20 | criminal offenses committed by or against Indians or other | ||
| 21 | persons within Indian reservations and over civil causes of | ||
| 22 | actions between Indians or other persons or to which Indians or | ||
| 23 | other persons are parties rising within Indian reservations. | ||
| 24 | (2) The civil and criminal laws of Florida shall obtain on | ||
| 25 | all Indian reservations in this state and shall be enforced in | ||
| 26 | the same manner as elsewhere throughout the state. | ||
| 27 | (3) Subsections (1) and (2) of this section do not apply | ||
| 28 | to Indian reservations of the Miccosukee Tribe of Indians of | ||
| 29 | Florida. | ||
| 30 | Section 2. If any law amended by this act was also amended | ||
| 31 | by a law enacted at the 2003 Regular Session of the Legislature, | ||
| 32 | such laws shall be construed as if they had been enacted at the | ||
| 33 | same session of the Legislature, and full effect shall be given | ||
| 34 | to each if possible. | ||
| 35 | Section 3. This act shall take effect upon becoming a law. | ||
