14          Amendment (with title amendment)
15          Between line(s) 843 and 844, insert:
16          Section 35. In order to implement Specific Appropriation
17    62 of the 2003-2004 General Appropriations Act, paragraph (c) of
18    subsection (2) of section 1011.71, Florida Statutes, is amended
19    to read:
20          1011.71 District school tax.--
21          (2) In addition to the maximum millage levy as provided in
22    subsection (1), each school board may levy not more than 2 mills
23    against the taxable value for school purposes to fund:
24          (c) The purchase, lease-purchase, or lease of school
25    buses; drivers' education vehicles; motor vehicles used for the
26    maintenance or operation of plants and equipment; security
27    vehicles; orvehicles used in storing or distributing materials
28    and equipment; or payment of the cost of school buses when a
29    school district contracts with a private entity to provide
30    student transportation services and the contract provides that:
31          1. The private entity shall purchase, own, operate, and
32    maintain one or more school buses of a specific type and size
33    that meets the requirements of s. 1006.25;
34          2. Each school bus shall be used for the daily
35    transportation of public school students in the manner required
36    by the school district;
37          3. Payment by the school district for each school bus
38    shall not exceed 10 percent of the purchase price of the state
39    pool bid for each such required school bus; and
40          4. The proposed expenditure of funds for this purpose must
41    have been included in the district school board's notice of
42    proposed tax for school capital outlay as provided in s.
43    200.065(9).

45          Violations of these expenditure provisions shall result in an
46    equal dollar reduction in the Florida Education Finance Program
47    (FEFP) funds for the violating district in the fiscal year
48    following the audit citation.
49          Section 36. The amendment of paragraph (c) of subsection
50    (2) of s. 1011.71, Florida Statutes, by this act shall expire on
51    July 1, 2004, and the text of that paragraph shall revert to
52    that in existence on June 30, 2003, except that any amendments
53    to such text enacted other than by this act shall be preserved
54    and continue to operate to the extent that such amendments are
55    not dependent upon the portions of such text which expire
56    pursuant to the provisions of this act.
