15          Between line(s) 5243 & 5244, insert:
16          Section 39. (1) There is established a Joint Select
17    Committee on Workers' Compensation Rating Reform. The committee
18    shall study the merits of requiring each workers' compensation
19    insurer to individually file its expense and profit portion of a
20    rate filing, while permitting each insurer to use a lost cost
21    filing made by a licensed rating organization. The committee
22    shall also study options for the current prior approval system
23    for workers' compensation rate filings, including, but not
24    limited to, rate filing procedures that would promote greater
25    competition and would encourage insurers to write workers'
26    compensation coverage in the state while protecting employers
27    from rates that are excessive, inadequate, or unfairly
28    discriminatory.
29          (2) The committee shall be composed of three senators
30    appointed by the President of the Senate and three
31    representatives appointed by the Speaker of the House of
32    Representatives. The appointed members of the committee shall
33    elect a chair and a vice chair. The staffs of the Senate Banking
34    and Insurance Committee and the House Insurance Committee shall
35    serve as staff for the committee. The Department of Financial
36    Services and the Office of Insurance Regulation shall provide
37    information and assistance as requested by the committee.
38          (3) The committee shall issue its final report and
39    recommendations to the President of the Senate and the Speaker
40    of the House of Representatives by December 1, 2003.
