15          Amendment (with title amendment)
16          Between line(s) 5243 & 5244, insert:
17          Section 39. (1) There is established a Joint Select
18    Committee on Workers’ Compensation Rating Reform. The committee
19    shall study the merits of requiring each workers’ compensation
20    insurer to individually file its expense and profit portion of a
21    rate filing, while permitting each insurer to use a lost cost
22    filing made by a licensed rating organization. The committee
23    shall also study options for the current prior approval system
24    for workers’ compensation rate filings, including, but not
25    limited to, rate filing procedures that would promote greater
26    competition and would encourage insurers to write workers'
27    compensation coverage in the state while protecting employers
28    from rates that are excessive, inadequate, or unfairly
29    discriminatory.
30          (2) The committee shall be composed of three Senators
31    appointed by the President of the Senate and three
32    Representatives appointed by the Speaker of the House of
33    Representatives. The appointed members of the committee shall
34    elect a chair and vice chair. The staffs of the Senate Banking
35    and Insurance Committee and the House Insurance Committee shall
36    serve as staff for the committee. The Department of Financial
37    Services shall provide information and assistance as requested
38    by the committee.
39          (3) The committee shall issue its final report and
40    recommendations to the President of the Senate and the Speaker
41    of the House of Representatives by December 1, 2003.
