Section 39. (1) There is established a Joint Select |
19
|
Committee on Workers’ Compensation Rating Reform. The committee |
20
|
shall study the merits of requiring each workers’ compensation |
21
|
insurer to individually file its expense and profit portion of a |
22
|
rate filing, while permitting each insurer to use a lost cost |
23
|
filing made by a licensed rating organization. The committee |
24
|
shall also study options for the current prior approval system |
25
|
for workers’ compensation rate filings, including, but not |
26
|
limited to, rate filing procedures that would promote greater |
27
|
competition and would encourage insurers to write workers' |
28
|
compensation coverage in the state while protecting employers |
29
|
from rates that are excessive, inadequate, or unfairly |
30
|
discriminatory.

(2) The committee shall be composed of three Senators |
32
|
appointed by the President of the Senate and three |
33
|
Representatives appointed by the Speaker of the House of |
34
|
Representatives. The appointed members of the committee shall |
35
|
elect a chair and vice chair. The Department of Financial |
36
|
Services shall provide information and assistance as requested |
37
|
by the committee.

|
(3) The committee shall issue its final report and |
39
|
recommendations to the President of the Senate and the Speaker |
40
|
of the House of Representatives by December 1, 2003. The |
41
|
committee shall terminate on December 1, 2003.
